The Constitution is a document of enumerated powers, not unlimited powers. The whole purpose of the US Const is to limit the power of govt.
If they want to regulate health care, they MUST pass a constitutional amendment in order to do so, because health care is not an enumerated power.

As with 99% of the "debate" that goes on on the Senate floor, that little bit of fluff was intended to be rhetorical red meat thrown to an energetic segment of the current Republican base (the "Tenthers"). By the same token, it can also be red meat thrown to the ant-Republican base.
Neither of those two purposes require that it make any sense, however, and it didn't. Intellectual consistency is the only thing that's ever really "rationed" in the Senate these days.
