In a war zone, the military are allowed to kill people without first putting them on trial. You can't compare it to WWII. With the Nazis, WWII was over and Germany had surrendered. bin Laden hadn't surrendered. From what we know of the situation, bin Laden was going for his gun when he was shot.

My only concern would be the immense cost and circus act the trial would have caused. You can't compare OBL to Nazi War criminals, or even Charlie Manson. Why? Because we have things like Twitter, Facebook, instant access to news. The trial could of lasted a year. And what if, just what IF somebody screwed up and OBL was let go?. The Nazis were tried under the principle of legal victor's justice, the Nuremberg trials were kangaroo courts, as were the Tokyo trials, as seen partly on the reasoning of revenge and exclusion of certain elements from trial at all.

But it was still more than bin Laden got. He would most probably have been sent to a military tribunal in Gitmo and sentenced to death under some parallel legal system with a highly questionable trial.
