You must maintain control with your rights. Cops control includes lying to you. You ask Am I being detained? Most cops will try to lie and say you are required to answer questions. You must maintain control with your rights. Your control means persistence in protecting your rights.

@xxsm13xx You close the door. Hopefully, you did not give them entry to your premises. Police cannot order you out of your home. As long as you are inside your house, you have all the power. They cannot enter without consent, a warrant or extenuating circumstances ie chasing a violent offender into a house.

in new mexico they all say your required by state law to have a id 24/7 on you in public. is that true? of course driving, but they say for walking, in a store, etc.

Sure. A driver is someone who uses the roadways for commerce. Truckers, they are drivers. You don't drive, you travel. When you go to work, you TRAVEL to work. Every court in the country has to be in line with the rulings from the supreme court. There is no question that a citation issued by a police officer, for no driver's license, current vehicle registration, or mandatory insurance, etc., which carries a fine or jail time, is a penalty and is indeed converting a right into a crime. If the cop writes a person a citation for a violation, that person needs to positively ID him/her self or go to jail. ID = Drivers Lic. Or State ID. ((NOT a student ID, Work ID)). So you dont need to show the cop a id unless you are going to be cited. If you dont have a id at that point of being arrested, then a legal custodial search. that gets your pockets turned out, bags opened.

Technically, you never have to show ID unless you are driving a vehicle. In many states you DO have to state your full real name if you have been "lawfully detained." You can refuse a search if the officer is just looking for your ID when you were not driving because you do not need one in that situation.

If you dont want to charged with a lot more things dont give the cop the reason. Disorderly conduct, you shouting waving your hand in the cops face, nudging the cop out you face, spiting, calling names.

Friends who try to help can end up with charges like, obstructing legal process.

FYI, all this information only works when dealing with an honest police officer. In my experience, that is about a 50% chance of happening. I appreciate little more than an honest cop, and despise little more than a dishonest one.

Most legislative acts in the states are only for commercial drivers' licenses and do not include "non-commercial" licenses

Hi yZeCounsel. I've heard that argument before, but I'm very skeptical about that. My understanding from talking to lawyers is that the state requires you to have a license to operate ANY motor vehicle. You can pretty much guarantee that you'll get a ticket, or worse, if you're driving without one.

well, I have beat an expired DL over 4 months & challenged the state on their authority to require me to have a DL
