NH Statute 644:6 criminalizes merely existing, under circumstances that warrant alarm to anyone, allowing consideration of taking flight on seeing a LEO, concealing any object, or examining a door to a building without legitimate purpose to enter.
A LEO may regard "walking away" as "taking flight", even though walking away has been ruled not suspicious of criminal involvement. Neither is concealing an object. "Legitimate" allows too much discretion (Kolender v. Lawson)
New Hampshire has some clearly unconstitutional stop-and-identify laws. Statute 594:2 says, "A peace officer may stop any person abroad whom he has reason to suspect is committing, has committed or is about to commit a crime, and may demand of him his name, address, business abroad and where he is going."
I assume "demand" means "ask and arrest if not given". The reasoning in Hiibel makes it clear that those demands other than name violate the Fifth Amendment.
The cops could have arrested him as the Supreme Court just ruled on this in Hiibel v. Sixth Judicial District Court of Nevada. "Hiibel -- who claimed he had done nothing wrong and was simply the victim of mistaken identity -- believed he had no obligation to tell the officer his name.
But the Court found that neither Hiibel's Fourth Amendment right against unreasonable searches and seizures, nor his Fifth Amendment right against self-incrimination, was violated."
The decision in Hibbel requires the constraints of a "Terry" stop before ID must be given.
"The Court is now of the view that Terry principles permit a State to require a suspect to disclose his name in the course of a Terry stop. " (Hiibel)
The officer admitted it wasn't a Terry stop at 1:30 and 1:40. I stopped researching after that time stamp.

Still, that quote is correct, with the understanding that the STATE being allowed that does not mean the POLICE are necessarily allowed that. Before the police may punish a person for failure to ID, the state must pass a law that requires reasonable suspicion first, and only then criminalizes failure to state their name on demand.

The cops looked like they were honestly looking for someone, and you reasonably resembled the person they were looking for.
I am glad it worked out for you, but got to tell you, cops are allowed to make mistakes, and they could just as easily have arrested you, held you for 24 hours, (or indefinitely, (until in front of a judge) if they really believed that you were that Russell guy) and in the end, for wasting all your time, all you would have received was an, "oops, we made a mistake."

@Qomowale Learn what "operating" and "driving" means. They are both commercial activities. Legal dictionaries and the Acts that were passed define those words. A "motor vehicle" is something used in commerce, "transporting persons or property for hire"(that's the short legal. def. of "drive").

If you truly match the description of a criminal suspect, then, of course you should present ID. It's good that you stuck to your guns so that they brought their photo out to compare and saw that you really didn't look like their suspect.
The officer must have reason to believe you are that canning. so the cop has pc to believe you are that canning. At that point he has the right to detain him to check or investigate him for a short time. take him to cop house and phota or finger print him and check his id.

I just came from a video where a news reporter was arrested for reporting a traffic incident. Did absolutely nothing against the law. Just because a top tells you to leave an area, doesn't mean he has the right to, yet they abuse the rights of citizens every single day. The reason the cop did nothing was because Jim was right.

It could be argued ..and has been argued in court, that as soon as one question is asked...that defined the start of an investigation. That includes the question do you have any ID? Hence the right not to show any ID. Presumably, the cops starts such an investigation correctly ..(.i.e probable cause, witness to crime, or suspicion of a crime under current investigation.)

@joekuta Here is how the system works.... If an officer asks for your ID, by law, you do not have to show it to him/her. The only information you are required to give to an officer is your name. In this case, this mans name is Jim Johnson. If you are being detained and you refuse to properly identify yourself, then you have committed a crime. If you are not being detained, then you are free to go.

@joekuta If you are driving on a public road and you are pulled over by an officer, then you need to show your ID, but if you are walking on the Street... you do not need to provide your ID unless the officer has reasonable suspicion that you have committed a crime, then you will be detained and required to show your ID. There is not law that requires you to carry an ID if you are just walking down the street.

New Hampshire has some clearly unconstitutional stop-and-identify laws. Statute 594:2 says, "A peace officer may stop any person abroad whom he has reason to suspect is committing, has committed or is about to commit a crime, and may demand of him his name, address, business abroad and where he is going."
I assume "demand" means "ask and arrest if not given". The reasoning in Hiibel makes it clear that those demands other than name violate the Fifth Amendment.

It could be argued ..and has been argued in court, that as soon as one question is asked...that defined the start of an investigation. That includes the question do you have any ID? Hence the right not to show any ID. Presumably, the cops starts such an investigation correctly ..(.i.e probable cause, witness to crime, or suspicion of a crime under current investigation.)

@2009stalker Cops are there for a reason, To uphold the law. You have NO obligation to show I.D to a cop whatsoever unless youre behind the wheel of a motor vehicle and youre pulled over for whatever reason. And youre right, he did do his job when he knew that there was nothing he could do about the guy not complying to his orders. Your idea of privacy compared to other peoples may vary. You cooperate with cops when you dont have to, I dont, you yes sir no sir a cop when you dont have to.

No, He may detain and ASK for I.D. The "suspect" has no obligation to give I.D, Only verbal I.D is needed. The name is then ran, the "suspects" picture pops up, is confirmed and he is released. At no time was he obligated to show I.D. Again, there was no crime being comitted so he WAS NOT obligated to give I.D.

Look like a criminal and be questioned everytime you walk out of your house and you'll see how old it gets. I was stopped 3 times in one day Because I "looked like a suspect" And of course they lied and said I have to show I.D and all this bullshit. But I knew it was B S. @2009stalker That would be awesome. I've never called a cop for anything, Ive always been able to take care of my problems without the useless police force. A man who appeals to the law is either a fool or a coward, a man who cannot live without that law is both. The comment "If to show id is too much for you then you are degrading." does not make sense. If you plan on debating someone, have an education greater than a 12 year old. And you my friend are both a fool and a coward.

@2009stalker Never called a cop because they're useless and only show up to take the report after a crime has been committed. The point is People do not have to show I.D unless driving a motor vehicle, this includes criminals. If the cop has suspicion someone is a wanted criminal they have the right to detain a person and put them in a line up.You have the impression that cops have ultimate authority,You are wrong. Violating freedom is NEVER a simple thing.Use your freedoms before you lose them.

Next time a criminal is asked for ID then his rights should not be questioned either? Good luck getting ANYONE arrested. There is a place to assert rights, and I do not feel any injustice is caused by asking a person in question for an ID.

@TwiztedAnimator u misunderstood; there is an investigation for a criminal, a man that looks like him. My point is how does any party know who he is or is not, if one does not have to show ID? This is very simple, we have a system to exercise justice. COOPERATING with the system could be evidenced by showing ID when questioned. He is in disagreement with the system, and I have to wonder why? Unless this man is guilty, what benefit does this provide?

@joekuta Here is how the system works.... If an officer asks for your ID, by law, you do not have to show it to him/her. The only information you are required to give to an officer is your name. In this case, this mans name is Jim Johnson. If you are being detained and you refuse to properly identify yourself, then you have committed a crime. If you are not being detained, then you are free to go.

@joekuta If you are driving on a public road and you are pulled over by an officer, then you need to show your ID, but if you are walking on the Street... you do not need to provide your ID unless the officer has reasonable suspicion that you have committed a crime, then you will be detained and required to show your ID. There is not law that requires you to carry an ID if you are just walking down the street.

And no it wasn't easy it was a pain cause I'd like to post you a link to the whole thing. Anyway it's from the official code of georgia annotated it's like a compendium of laws. So maybe that's why. So rather than say any man or woman they just say person, it's easier and can be applied to fictional entities too. These legal entities exist for a reason. It allows them to make business deals buy and own property and if you define a fictional entity as a person it makes them accountable to the law. I feel I have proven this saying otherwise does not make it so.

@rentiap um I don't feel I'm devils advocate for the word person. It's a good word and it does in fact apply to individual men and women also. Even in regular speech its never used to refer to a fictional entity. If you refered to a corporation as a person anywhere but in a civil suit people would think you were out of your mind. Also you kept saying "Show me the law" so of course I was going to show you the law. I don't think that makes me obtuse. I only did what you asked.

"Person" shall include any individual, corporation, association, partnership, trustee, lessee, agent or assignee.
I'm not sure, but I think "individual" would include a man or a woman.
