In those instances where things get thrown out it's because the officers thought they had an exception in good faith and on review they didn't. Most get upheld because of the exception to the warrant requirement. My point still stands that the guy with the "fake warrant" story is full of shit.

It doesn't matter if they just peek inside your windows and leave, they violated the boundaries of the property by hopping the fence, and their "peek" constitutes an illegal search.

The best thing when dealing with the cops is keep your mouth shut do not tell them anything just say i will only talk in the presense of a lawyer if you are arrested if you are not under arrest get away quickly by saying am i free to go

Same thing kind of goes for a car. If you get pulled over and your car some how mysteriously reeks of herbs and medication, then roll up your windows, grab your documentation from the glovebox and step outside of the car before the cop gets up to your vehicle. :)

The knew the law and even with the warrant they knew they were allowed to call the office of the judge who issued the warrant, at which point they found out it was a FALSE warrant never issued by that office.

I have a friend who got sued about 5 years ago. He had an idea that it was coming and ALWAYS checked his mail before dawn and avoided being served for TWO YEARS by NOT opening his door for anyone he did not recognize. He was already retired so there was no chance of "serve him when he goes to work." 'Don't open the door....' is absolutely TRUE! BTW he won.
Even better is just ignore them. They cannot kick the door in unless they believe someone is in imminent danger. That is what the Supreme Court ruling said. If they hear or see nothing to lead them to that conclusion , then they can't come in without a search warrant. If they come in anyway than what they find can likely be suppressed in court as evidence against you. As long as the cops tell the truth....

Great advice for people who may not understand their rights but I fear that rights as we know them are a thing of the past. Indiana supreme court passed a law on May 15, 2011 that states that it's citizens have no right to resist unlawful police entry. If this isn't stopped in Indiana I'd expect it to go nationwide very soon. This has been sparsely covered by the media, most attention I've seen in response was about how the police are looking for those who have made threats against officials.
While this advice is pretty good, I am concerned about telling the cops, "if you have a warrant, kick the door in" I would say "I want to be left alone" and "If you don't have a specific warrant, you are tresspassing" along with "please leave"

There are bad eggs in any profession, but it's been my experience that they tend to get flushed out. One of my best friend's brother is a cop and he takes his job very seriously, doing his best to be an example of a good, law-abiding citizen. It's your right to refuse a warrantless search, but 99% of the time the subject won't even come up unless YOU give a cop a reason to suspect you.

@maverick10241 One of my run-in's with the law was in TN. It was a TN State Trooper who clocked me at 70 in the days of the 55 MPH speed limit. He had me come back to his car to write the citation, but we actually had a good conversation. I asked some questions about his radio equipment and he was more than happy to answer. In the end he knocked the ticket down to 65 which lowered the fine considerably. I found him to be a nice guy. cont'

A kicked in door is evidence of a refusal to consent to a search and your 4th amendment rights remain intact. @mttmead Right, but what you fail to understand is that there legally defined exceptions to the warrant requirement, exigent circumstances due to the destruction of evidence is one of those. In those instances where things get thrown out it's because the officers thought they had an exception in good faith and on review they didn't. Most get upheld because of the exception to the warrant requirement. My point still stands that the guy with the "fake warrant" story is full of shit.

With true consent that is not coerced the police DO NOT NEED A WARRANT to seize contraband they see inside your house and charge you. If they coerced you to give consent by lying to you then you can most likely get it thrown out in court. But my original point still remains: NO COP will ever try to get in your house with a FAKE warrant.

It doesn't matter if they just peek inside your windows and leave, they violated the boundaries of the property by hopping the fence, and their "peek" constitutes an illegal search.

If the yard is fenced in, they CANNOT bypass that fence, especially if it's the main house.
Even a free standing garage on a standard sized suburban neighborhood lot is considered "within the curtilage" as set down by the U.S. vs Dunn SCOTUS decision.
The 4th Amendment doesn't say anything about "curtilage", it DOES say "effects" which by definition includes PROPERTY.

The knew the law and even with the warrant they knew they were allowed to call the office of the judge who issued the warrant, at which point they found out it was a FALSE warrant never issued by that office.
Doesn't matter if you're good or not, the cops aren't always good ones.

You still do not have to allow entry - a real warrant, as Barry explained, grants permission for fast and forcible entry, so say "no" even if they say there is or show you one (because it is a lie/fake). However, I would not invite them to do it as Barry jested - it can be misused by police as you granting permission to enter.

He had an idea that it was coming and ALWAYS checked his mail before dawn and avoided being served for TWO YEARS by NOT opening his door for anyone he did not recognize. If they hear or see nothing to lead them to that conclusion , then they can't come in without a search warrant. @holygasp They sometimes try to come in when & if they get the chance. I turned my back for a few seconds while I shut my dog up & to my surprise they already had opened the door. After pointing out that my doorway camera had audio he simply closed my door & said "have a goodnight".

Great advice for people who may not understand their rights but I fear that rights as we know them are a thing of the past. Indiana supreme court passed a law on May 15, 2011 that states that it's citizens have no right to resist unlawful police entry. If this isn't stopped in Indiana I'd expect it to go nationwide very soon. This has been sparsely covered by the media, most attention I've seen in response was about how the police are looking for those who have made threats against officials.

While this advice is pretty good, I am concerned about telling the cops, "if you have a warrant, kick the door in" I would say "I want to be left alone" and "If you don't have a specific warrant, you are tresspassing" along with "please leave"

There are bad eggs in any profession, but it's been my experience that they tend to get flushed out. One of my best friend's brother is a cop and he takes his job very seriously, doing his best to be an example of a good, law-abiding citizen. It's your right to refuse a warrantless search, but 99% of the time the subject won't even come up unless YOU give a cop a reason to suspect you.

They do. You must live with a very corrupt police dept. if they don't. I used to have a bit of a lead foot and got pulled over more times than I want to admit. Never once did an officer want to search my car even though I was young. Never once has a cop come to my door and randomly wanted to search my house. Never.

@jtkirkfan2002 i think we got off on the wrong foot i live in tn and the south is well known for bad cops just go and look at how blacks where done by cops in the 1960,s when they stood up for there rights they where treated very bad.it still goes on in, tn cops have the [ no knock RULE ] no warrant to search just come in and destroy your home or car.tn cops are what you see in the walking tall story most are uneducated,mean,and do as they please we live with it everyday.my opinion ,like yours

@maverick10241 One of my run-in's with the law was in TN. It was a TN State Trooper who clocked me at 70 in the days of the 55 MPH speed limit. He had me come back to his car to write the citation, but we actually had a good conversation. I asked some questions about his radio equipment and he was more than happy to answer. In the end he knocked the ticket down to 65 which lowered the fine considerably. I found him to be a nice guy. cont'

Howevber, if the police have a warrant then there is no point not letting them in unless you want your property smashed and want to risk being in contempt of court. In the USA the Patriot Act suspended cvertain parts of the US Constituion including the 4th Amendment. So much for your FREEDOM!! Free to be searched and surveilled without warrant.

@cshubs because cops are allowed to lie during an investigation, they can even lie about having a warrant. A kicked in door is evidence of a refusal to consent to a search and your 4th amendment rights remain intact. An intact door becomes an argument of 'he said he had a warrent' , 'I never said I had a warrant, he opened the door voluntarily and let me in ...that's when i saw xyz in plain sight'

@badpanda84 Well, kicking in a door doesn't necessarily mean you have to replace the door anyway... more than likely just the 5-10 dollar molding around it that allows it to be locked/shut. Worst case, your door has a scuff on it also.

They only announce themselves so you don't pick up any weapons. Best thing to do is lie down and hope they don't beat you too badly.
