  • I'm glad Pastor Anderson was found not guilty. But what is his Pastor Anderson's recourse? Being found not guilty is not enough in a case like this. Someone should be held accountable and someone should have to pay.

  • My hats off to you Pastor Steven L Anderson. You are a great American. And by the way having a dog at an immigration check point is illegal (source: City of Indianapolis v. Edmond). It does not give border patrol agents the right to search a vehicle. Pastor Anderson was found not guilty of all charges at his trial and now he is suing these scumbag agents for violating his rights. Take them to the cleaners Pastor Anderson.

  • While I admire and fully support your standing up for your 4th amendment rights, once the DPS officer said you were under arrest, that was the end of it. You should have gotten out of the car, been arrested, and then sued for wrongful prosecution. When an officer tells you you're under arrest, you are under arrest, period. If he's wrong about it, fight it in court. You do NOT have the right to resist arrest for any reason, even by sitting in your car refusing to roll down the window.

  • @josacape If that were the case, then the state would have no authority to make arrests at all, because the question of whether an arrest is lawful or not, is not resolved until AFTER the arrest is made, by a court. You're the one who is quite wrong. Ask any lawyer.

  • @josacape If John Bad Elk had been legally allowed to resist arrest, then the case would have been thrown out and he would have been set free. He was not. The high court ordered the lower court to re-try him, and suggested that in Common Law, if the arrest was lawful, the conviction should be for murder, but if the arrest was not lawful, the conviction should be for manslaughter.

  • Well, you're right on one thing; can't change the namby-pamby--rush rush rush court system in place today.

    But, you are required to obey with what you are ordered to do by law enforcement. If you feel their orders are illegal or excessive, then you take it to the system afterwards, then their actions are scrutinized and proper action will be taken if fault is found. The system does work, it's the courts that allow ignorant civilians to make the decisions that doesn't.

  • I'm sorry, the pastor's point is correct, the cops exceeded their authority. Their search was illegal because it was unwarranted: drug dogs DO NOT alert unless there is contraband present. They hassled the pastor because he didn't obey, and used the dog as a pretense. On a side note, what the is wrong with FEMA?!? They are there to help people during national emergencies. I know, I worked with them to create a first responders training program. Please take off the tin foil hats people.

    I live in Idaho now, there's no such thing as natural disasters here. It's a pretty docile state, FEMA won't be needed here. And I'm pretty self sufficient, I doubt I'd need it to begin with...

    If ordered to, I'd have taken a criminal's firearm in a heartbeat, or shot 'em where he stood. Criminals don't deserve constitutional rights. But's the bleeding hearts who have warped laws to allow them rights.

  • @JemmetGK Ever read up about our Founding fathers? They were willing to sacrifice everything. They won their freedoms but some of the founding fathers lost their homes, family and wealth. They died a few years later, broken at having lost everything. But they made it possible for their brothers in arms to live in freedom. I am willing to die on my feet holding my rifle for freedom. Better that than slowly dying in a reeducation camp for political prisoners.

  • @JemmetGK Yes, in that situation i would have followed the tactic: Fight the battles you can win. It very VERY difficult to win a argument with a cop about the law. The only way they would back off is if a whole news camera crew was there. They will then let you off with a warning, But then pull you over in a isolated area to really get revenge on you. LOL

    True but that does not excuse the fact that the police had the right to detain him and arrest him with no proof or evidence. If the dog detected drugs or concealed humans (what?) then the police would have been obliged to show Anderson. Simple and easy.

    In the end the police used excessive force, breaking the glass on Anderson car, tazzing him, brutally beating him. The worse thing about this issues is that it could happen to YOU, ME or ANYBODY.

    I used to live in Las Cruces, New Mexico, attended NMSU. I frequently (once or twice a month) went through El Paso into Juarez to go shopping and had to (of course) go through border patrol's litany of questions and searches. I NEVER gave any reason for them to be suspicious of me: never argued, was never nervous, never told them no to anything they wished to look at or inspect, never said I know the law better. I NEVER had a problem. I NEVER had an incident.

  • @JemmetGK: The courts have been very clear that a person is not required to obey unlawful orders. The court was also clear that the driver here was not guilty of the charges levied against him. Of course, you are free to disagree with the justice system in this case, but your disagreement doesn't alter the facts or results of this incident.
