In that hypothetical situation the person wasn't out of line in having their weapon drawn.
Grant was already on the ground with two cops on top of him. There's no reason to draw a taser OR a gun. Johannes Mehserle attended and graduated from police academy. He was further trained when joining the BART police force.
He's being charged with murder because he disregarded protocol and his training in the process of shooting a restrained man in the back.
