  • The border patrol in indio know me cause i work out there everyday and I have my scrubs on..They get mad at me because they ask me where i work and i tell them they are violating my 4th amendment right. Always they search my car and claim it was a k-9 alert. Yesterday it was worse..they said dog is too excited..told me to get out of my car..they handcuffed me did illegal patdown,detained me for hour and found nothing in my car as usual. I am so tired of there abuse

  • First of all yes the rights are going away fast, If they have a warrent they have the right to search anywhere inside or outside at that address only for what is listed on the warrent, nothing else. Problem is if anything else is removed you have to be able to prove it. Appearently they could not get a conviction with what they took so they left it be. Make electronic copies of all your work and store them someplace outside the house on a DVD or such, maybe a safe deposit box. Just a thought.

  • i just read this aloud to my teacher who is has been an officer for twelve years...he said it all depends on what they were looking for on the search warrant.

  • If they had a warrant for "specific stolen property" then they are not allowed to take anything else what so ever. they are only allowed to take what is specificly stated on the warrant. however if they find anything else such as plants or something else that is illegal then they can go aquire another warrant for whatever they need to get it for. thats a violation of the 4th amendment and a lawyer should be contacted, and in my opinion charges should be pressed.

  • @Preacher0408 Lets say the cops was look for a stolen grand piano it was named on the warrant. they are not allowed to look in your desk drawer for it. Because it could not fit. So most of the warrants also tell the cops to look for documents that would prove that the person lived there (bad guy joe). So while looking for the doc. They find a 100 lb of weed in the spice cabinet it is legal. Under plain view exception to a search warrant. Do talk to a LAWYER.

  • @samten10a yeah they find the weed in the spice cabinet and under the 4th amendment they cannot take the weed unless they have a warrant for it. if they were there searching for drugs then they can take it. so buddy, YOU go talk to a LAWYER

  • Well, thereis a few things. First of all, was the notebook in planeview(this always makes it fair game no matter what), or was it in your personal room? and second, was it incriminating evidence, for example...were yall being raided for a marijuana growth/drug bust? Last thing...when it comes to drugs, not EVERYTHING has to be written on the warrant. If they had a warrant to search for say, heroin, would you expect them to leave the needles found with it (used or not)?

  • although im only 16 i think i could help hyou because im taking law, and to answer your question, you really cant do much since none of you rights/ amendments were broken, as long as they have probable couse in this case was your friend, they can get a search warent, and with that warrent they can seize anything in your home as long as they have good reason or probable couse that, that item in your home will lead them to a crime, or someone commiting a crime. hope that helped you

  • No. The warrent will list all the items they are allowed to take if the item was not on the warrent they can't charge you for it. Even if it was drugs(they wont let you keep that but they cant charge you)

  • thats where your wrong all they need is probable cause,an example, a person is a drug lord,the warrent wont have items on it like, crack, so when they search the drug lords home they find crack, weed, illegal weapons, and more and only charge him for the crack. instead they may have on the warrent that there looing for a drugs and if durring the search they find something else tats illegal they have the right to take that as evidence and charge you for it

  • it all depends on what you said and did when the officers knocked on the door. If the cops had an arrest warnt or seach warnt.

    where the binder was to the relation to the person arrested. makes all the differance in the world if it leagle or not.

  • I agree with fern your right to be secure in your ...... and paters etc. WAS violated. First i am almost sure that any warrant issued did not describe that binder. And for that officer to rip any thing out of it that was not part of that search and or siezure order is a clear violation of your fourth amendment right. Any one who tells you to forget it or that you should just shut up is the type of person who doesn't care about their life much less anyone elses. Do what you feel is right for you.

  • These police officers violated your constitutional rights as laid out by the fourth amendment. Police officers may only enter your home with a warrant and confiscate only that detailed by the warrant. You should contact your state ACLU office. it may have been a small violation, but if we let something small go then what will they try next. Americans need to stop giving up our rights. KNOW YOUR RIGHTS. EXERCISE THEM.

  • I think you would be spending more time and money than it is worth. Unless they kicked your ass, maliciously prosecuted you or wrecked your house. If they confiscated it as evidence and gave you a receipt - you can simply get it back. Otherwise - maybe it's under your couch. But I do understand because I have had my 4th ammendment rights violated and it really just pisses me off

  • you shoulda deff speak with a lawyer he will tell you more about your situation, my house was also raided warrantless while i was in jail they enterd my house and removed 4 computers, 2 video cameras, a projection system, 3 firearms, 200 grams of marijuana, lsd, ecstasy, over 1,000 cannabis seeds, 13 pipes/bongs, and they even removed the safes,, i got a lawyer and guess what i have no charges from any of that, but ill never see any of it again, luckily i had all my money stuffed unda the couch

  • Did you have the gun outside? Why were they there? Sounds like to me illegal seizure,but I can't be sure without all the facts of the incident. In a lot of instances, police use their catch-all reason, "probable cause" RIGHT! This is their way out of the improper procedures,and illegal search and seizures.

    I remember when a person was innocent until proven guilty, but now days, you are guilty until proven innocent. Are the police there to protect and serve or to abuse, harress and intimadate?
