In the October issue of the ABA Journal, the main story was about 'Kabuki confirmations' like the ones in recent history. I totally agree with that premise because confirmation hearings have become more about throwing stones at the nominee and basing your decision on how well they can deflect the attack, instead of testing the nominee's judicial prowess. It's a shame that the system embraces the shameless exploitation of a possible chink in someone's armor than testing their strength.
I watched these hearings. This guy was about 10X smarter than everyone grilling him. A couple people tried to bring the hammer with details of very old cases and the guy was like a history book.
Just because John Roberts appreared smart in his confirmation hearings does not mean his decisions are beyond question. Roberts asserted the importance of precedent in his confirmation hearings and turned around and didn't do that in Citizens United. He should be impeached for this.
Actually according to a recent poll Thomas is the most Conservative Justice not just among the current justices but among the former ones too. Among all Justices in history. Scalia is known for being independent minded. I definatly don't agree with everything he has voted on such as Bush V. Gore. But I respect his independent judgement.

Absolutely agree. Roberts was laughing on the inside. Because people like McCain have promised to elect justices to the SC when some retire or die who will overturn RvW. That's why. It's not the governments business what women do to their own body.
The 14th Amendment states, "No state shall deprive any person of life, liberty...". Roe v. Wade assumes that "person" refers to people who have been born, whereas conservatives (a.k.a. strict constructionists) believe that includes a fetus. If enough conservatives get on the board to rule that the Amendment DOES protect fetuses, then they will place into law a constitutional ban on abortion. That's why they're worried.
It's funny how Senators make themselves look like asses all by themselves..."super-duper precedent", "he's filibustering", etc. What a bunch of assholes...there really needs to be term limits for Senators.
