@Quizguys Nintendo can't use Banjo and Kazooie for SSB, SSBM, or SSBB because they were already bought by Microsoft. Rare and Mircosoft has full rights to Banjo-Kazooie so Nintendo would have to pay a lot of money to just buy Banjo-Kazooie, but Rare would lose money because they lost their key characters for their games. Besides, Rare still makes Donkey Kong games for the Nintendo DS because Microsoft isn't in the "Handheld Wars".

Rare is a First Party Company, not a Third Party Anymore.
