the DS is not as easy to pirate as the psp, there are hard-mods for it and Nintendo could easily pursue people in court who do DS modding services.

And for everyone that things otherwise the psp has an attach rate of less than 3, look at the highest selling game for psp and the units sold, and the same for ps3 with no piracy and less units sold, it's obvious.

The ds is easier to pirate for, atleast for the average person. Just buy a flash cart (Mine was five dollars.) And stick some games on it. With a psp you have to go about flashing the firmware, which is definitely harder for the non computer savvy. Not that either of them are exactly difficult to pirate for.
