There is no reason for her to give her name. That is her right to privacy, and unless the officer has good reason to suspect that she has committed a felony, or is planning to commit a felony, she is not required by law to give her name.

Her actions made him responsible for verifying who she is and why she tried to run. What if she was wanted for murdering your child or your mother. You never have to give your name unless you are being charged...up to that point you can even give fake information. If you're being charged it's best to keep quiet and don't even acknowledge them or your rights. As soon as you acknowledge that you do understand your rights you're f'd.

A lot of Police in the US have gotten out of control. I once had the same thing happen to me, but it ended differently because I live in Canada, where at least most of the police act like human beings. I had a new and old ID on me as well, and ended up showing both cause I showed the cop the old one first (he said it was expired), so I showed him the new one. He then informed me that it was illegal to have two licenses and told me to cut it up the old one when I had the chance. That was it.

Look up some of the vids here on YouTube - cops get pissed when you don't comply, but that's their problem. You can record video AND sound of the cops in 48 states, and they can't legally prevent you from doing it. They'll ASK you to stop - even demand that you stop - but you don't have to.

This girl should never have been arrested. This was a blatant misuse of force and a arrest under false pretenses. Identifying yourself is required if asked by a police officer, in the event he/she has probable cause to ask. In this case he did, and she gave him her info. He is in a lot of trouble. What a worthless jerk, it is plain and obvious what was going on. The state getting her name does not outweigh the security of her child. Any man that doesn't get that needs to be neutered. Note how someone mentions that they know who she is anyway. The cop driving knew that what he was doing was wrong, and he did it anyway.

You are not supposed to check up on the reason for this? like maybe a warrant for arrest or maybe another illegal leech on society? @Airportris She committed no crime and that is why she was released. The officer simply asked her for ID as she was a witness to an accident and she ran. Her actions made him responsible for verifying who she is and why she tried to run. What if she was wanted for murdering your child or your mother. I'm sure you wouldn't hesitate to sue the police officer and department if he just let her run away. She is here illegally but she has an anchor baby so she should not have run.

I have had a few personal experiences myself with cops that do not know the laws the are enforcing and some that are just bullies and punks. However this officer's hand was forced when she ran and acted suspiciously. No where in the constitution does it say you are required to give an ID and if she just told him no I do not want to be a witness the officer would have dropped it.

@Airportris as I said before once she ran the officer is required to find out why and murder sis a perfect example to use here. Why did she run? the officer doesn't know. If it turns out she ran because she was wanted for murder or another serious crime the officer would be liable for letting her go. I'm not sure why you don't understand this.

You never have to give your name unless you are being charged...up to that point you can even give fake information. If you're being charged it's best to keep quiet and don't even acknowledge them or your rights. As soon as you acknowledge that you do understand your rights you're f'd.

my bother got arrested for having 2 ID's with him, not a fake ID an old ID that he thought he lost, he issued a new one then he found the old one... 2 ID's same picture same person same information. I mean what the fuck is the world coming to... confiscate one ID or something, the guy spent almost 3 days in jail LOL i mean seriously?!? are you guys serious?! it takes longer to get your drivers license in most countries (by far) than it takes to be a cop... something is wrong with that

A lot of Police in the US have gotten out of control. I once had the same thing happen to me, but it ended differently because I live in Canada, where at least most of the police act like human beings. I had a new and old ID on me as well, and ended up showing both cause I showed the cop the old one first (he said it was expired), so I showed him the new one. He then informed me that it was illegal to have two licenses and told me to cut it up the old one when I had the chance. That was it.

The problem is democracy. It has become the overriding policy. When you have 51% of the electorate that can vote away the rights of the other 49%, that's democracy. The U.S. is a constitutional republic where individual rights should trump democracy, but not anymore. Pure democracies always end up tyranical for the above reasons. The US needs to return to the priciples of the constitution and the bill of rights. Democracy needs to be limited by the constitution.
