I don't care what the patron said. He was clearly off the property, wasn't putting his hands on anybody, so the bouncer had no legal right to strike him. Even if the guy was saying "c'mon, let's fight" or "go fuck your mother", it was still assault and battery.

There's no excuse for lack of civilized behavior, otherwise you'd have to be afraid of going to a diner and complaining about spilled coffee, lest the waitress throw the whole pot in your face.
If you work in a bar, you're going to inevitably wind up dealing with people who've had a bit too much to drink. The patron may be acting like an asshole at the moment, but the bar did allow him onto their property and they had no problem taking his money in the first place, so they shouldn't treat him like an enemy. A bouncer must always use tact and diplomacy unless he or somebody else is in immediate physical danger.
The average patron will behave better next time around, after realizing that he's embarrassed himself, and if not, you can always ban him from entering the premises in the future.

I suppose after those bars face enough lawsuits and close down, and the towns that give them their liquor licenses require proper training and certifications for their security staff, they'll change their hiring policies. Im NOT defending this guy at all, but I have worked at clubs where even raising your voice to a customer might get a bouncer fired and others where if you didn't make it CLEAR that you planned to use as much force as was needed, we would get our asses handed to us. An owner's employee's have (by proxie) the authority of the OWNER and owners certainly have more authority on their own private property. All states here in the US (excep for NC where I live) have "citizen's arrest" but even THAT is a tricky thing and if you are a customer in a bar, YOU have to convince not just the police but the court later that you have enough evidence and that YOU weren't under the influince. AND if you lose, YOU might be charged with unlawful detention or even kidnapping.

Stabbings, a drunk person waving a gun around, THESE are what I consider "SERIOUS CRIMES". Someone selling drugs or swinging at someone happens at bars and clubs every night. @chrisdef15 (Part 2)..someone has been killed inside, serving a warrant, just a routine check. There are MANY situations in which they will enter a bar, but removing a drunk is NOT one of them. If you honestly believe, even though people threaten to sue me ANY time I touch them, I don't regularly educate myself on local as well as state laws as they apply to my job, nor do I deal with the police on an almost nightly basis.... I'm not going to argue with you about it.

Interestingly, even being drunk inside a bar is considered public intoxication. Bars are technically public places under state laws here in the US (despite being located on private property), and there have been a few cases in Texas and Virginia of cops conducting raids on bars arresting people merely for being drunk (mainly in a proactive attempt to curb DUIs). Pretty crazy, huh?

Even if he has broken no law, EMPLOYEES (not customers) have the right to EVICT him if he will not leave. They are there to make sure he then leaves without incident. (Tresspass, Shooting in the parking lot, etc) At my clubs, I employ off duty police for the parking lot. I'm not trying to say bouncers are deputized or something. You are misunderstanding me.
Again you must work in a majorly wimpy pub/club if the only problems you ever see is club rules being broken.
And yes police will step in when kicking people out of pubs/clubs and the reason is the patron being kicked out is breaking the law, its called tresspassing, its not just club rules, they also can easily add on drunk and disorderly and numerous other charges just in the process of dragging someone outside.
@chrisdef15 (Last part) When the police arrive, USUALLY the patron has NOT broken the law. Tresspassing (in my state) has to be sworn in the presence of a law enforcement officer. So he is NOT tresspassing YET. He is removed, THEN told not to come back. If he then doesn't leave, it is tresspassing. (Believe me, I had had MANY people arrested for this). Drunk and disorderly usually means OUTSIDE. If he is THAT bad inside that we can't get him, police will shut us down, remove him, and warn US.

I don't know about Australia but here they WILL NOT enter a club filled with hundreds of drunk and unruly patrons with their guns. It isn't safe for the officers nor the customers. They will and do tell the BOUNCERS to drag him outside if we have to. They will NEVER ask another customer to do that.
There are numerous clips just here on youtube of armed police in the US inside clubs so yes they certainly do.
And yes police regularly ask random people to help them. I agree at a club they will generally ask the bouncers to do it but that is basically because they are there and its there job, if there wasnt a bouncer around to help, and they needed help, i would guarantee you they would happily take it from anyone who will give it.

If you work in a bar, you're going to inevitably wind up dealing with people who've had a bit too much to drink. The patron may be acting like an asshole at the moment, but the bar did allow him onto their property and they had no problem taking his money in the first place, so they shouldn't treat him like an enemy. A bouncer must always use tact and diplomacy unless he or somebody else is in immediate physical danger.

If the police are called to a bar or club about an unruly customer, they won't come in the club to get him, They tell us (not regular civilians) to go get him, not, well ask him nicely and I am sure he will come quietly. An owner's employee's have (by proxie) the authority of the OWNER and owners certainly have more authority on their own private property. Bouncers are employees and are hired specifically for the purpose of maintaining order. NOT the same as anyone else. Bouncers shoudn't act like thugs or think they are cops BUT, as employees, do have a say so about what will or won't be allowed in a club.

All states here in the US (excep for NC where I live) have "citizen's arrest" but even THAT is a tricky thing and if you are a customer in a bar, YOU have to convince not just the police but the court later that you have enough evidence and that YOU weren't under the influince. AND if you lose, YOU might be charged with unlawful detention or even kidnapping.

Stabbings, a drunk person waving a gun around, THESE are what I consider "SERIOUS CRIMES". Someone selling drugs or swinging at someone happens at bars and clubs every night. Im not saying it happens at every bar but when I was a customer, I didn't see it much either. The state of things in a lot of our clubs really saddens me. I shot one person at a club already (in self defense) and was not prosecuted.

If you honestly believe, even though people threaten to sue me ANY time I touch them, I don't regularly educate myself on local as well as state laws as they apply to my job, nor do I deal with the police on an almost nightly basis.... Interestingly, even being drunk inside a bar is considered public intoxication. Bars are technically public places under state laws here in the US (despite being located on private property), and there have been a few cases in Texas and Virginia of cops conducting raids on bars arresting people merely for being drunk (mainly in a proactive attempt to curb DUIs). Pretty crazy, huh?

@chrisdef15 (Part 3) BTW..... The reason that police ask BOUNCERS to help and NOT customers is that, police enforce the law, not club rules. Even if he has broken no law, EMPLOYEES (not customers) have the right to EVICT him if he will not leave. They are there to make sure he then leaves without incident. (Tresspass, Shooting in the parking lot, etc) At my clubs, I employ off duty police for the parking lot. I'm not trying to say bouncers are deputized or something. You are misunderstanding me.

Again you must work in a majorly wimpy pub/club if the only problems you ever see is club rules being broken.
And yes police will step in when kicking people out of pubs/clubs and the reason is the patron being kicked out is breaking the law, its called tresspassing, its not just club rules, they also can easily add on drunk and disorderly and numerous other charges just in the process of dragging someone outside.

@chrisdef15 (Last part) When the police arrive, USUALLY the patron has NOT broken the law. Tresspassing (in my state) has to be sworn in the presence of a law enforcement officer. So he is NOT tresspassing YET. He is removed, THEN told not to come back. If he then doesn't leave, it is tresspassing. (Believe me, I had had MANY people arrested for this). Drunk and disorderly usually means OUTSIDE. If he is THAT bad inside that we can't get him, police will shut us down, remove him, and warn US.

@chrisdef15 (Part 2) And when I said that cops will not enter a club, perhaps I should have made it clear..... I am in the US. ALL of our police are armed ALL of the time. I don't know about Australia but here they WILL NOT enter a club filled with hundreds of drunk and unruly patrons with their guns. It isn't safe for the officers nor the customers. They will and do tell the BOUNCERS to drag him outside if we have to. They will NEVER ask another customer to do that.

There are numerous clips just here on youtube of armed police in the US inside clubs so yes they certainly do.
And yes police regularly ask random people to help them. I agree at a club they will generally ask the bouncers to do it but that is basically because they are there and its there job, if there wasnt a bouncer around to help, and they needed help, i would guarantee you they would happily take it from anyone who will give it.
