Also as far as "common law" that is a tricky term in itself. There can be no justice in the lower court. It will always have to go higher to the court of original jurisdiction to get satisfaction.
The ticket comes from a officer in the executive branch. If you understand law in the united states of America you will remember that there are 3 branches of government and they cannot cross. So, unit I recieve a summons to go to court from the judicial branch of government for any infraction, violation or crime, why would I even want to go to any court, least of all a kangaroo court with an administrator that probably doesn't even have an oath or bond?
I don't give legal advice, but if you look in the NY CPL you will find the rule that says, in order to commence an action there MUST be a SUMMONS and COMPLAINT. There is a plethora of NY court cases in the upper court that specifically states that a traffick ticket is not a summons, nor did you recieve it from someone from the judicial branch of government.
Also, how do you claim or ask for common law jurisdiction when you go into their traffic court?? I know you shouldn't stand when they call your person like, MR MILLER and stuff like that.. Do you challenge the courts jurisdiction verbally when the judge calls your case.. No one on You Tube seems to be able to answer these questions clearly...
Hey there, If I'm driving and get pulled over for a Traffic Infraction the officer will hand me the summons to appear = invitation in Blacks Law Dictionary or I can check a box to avoid court and just hand them over my money and be done with it. Do I legally or lawfully have to sign their summons?? If i don't have to sign should I write "contract not accepted" on the line and hand it back to the officer?
