This song was penned by Professor Moeen Ahsan Jazbi for Indian Film Ziddi in 1950. After 20 years he gave the copyrights to Pak Producer / Director who used it in Chand Suraj in 1970. Same story like Qateel Shifai sold his songs to Indians 20 years after expiry of copyrights in Pak. So both are legal.
