Many chronologists date the capture of Jerusalem by Herod to 37 B.C., the rebuilding of the Temple as beginning in 20 B.C., and Herod's death to either 4 B.C. or 1 B.C. The tradition can easily fit into a 1 B.C scenario. Jesus would then be subject to Herod Antipas (son of Herod the Great) under Tiberius Caesar.
We are discussing Jesus' conception and birth, not who he was subject to, which, according to the Gospels, took place before the death of Herod the Great (not during the reign of his son). 4BC? or 1BC? 10 year or 7 year pregnancy - you decide :)
If Barbara Walker would do just a little more research, she would find that it was Herod Antipas, who was the son of Herod the Great, that ruled from 4 BCE to 39 AD. She builds her argument of a 10 year pregnancy based upon a false premise.
The tradition states that Herod the Great ordered the slaughter of all boys under the age of two years, and Joseph took Mary and Jesus to Egypt for safety. Joseph did not bring his family back to Nazareth until after Herod the Great's death in 4 BC.
