It depends on the mens rea of the assailants and if they could determine that the kid was knocked out. A lot of school yard fights are gang-up fights. I was on the receiving end of a few of 'em as a kid. This kid was not seriously injured. A stop at a hospital and he was fine that night.

You don't know legal system then. Sometimes it IS maybe it is, maybe it isn't. There is a fine line with attemopted murder and he has a harder time proving it, which is probably why he has dropped charges to 2nd degree aggravated battery. But it is very common to start off with a higher charge, particularly when the investigations are still taking place. It helps in negotiations and it gives them room to lower the charges base don eveidence or lack thereof.
Many in the area wanted him to go ahead with hate crimes, but he upped the charges to attempted murder to appease the people of the community. He lowered them before trials. these are not out of the ordinary.
And yes, if he could prove the conspiracy was to do more than hurt them, and show medically that the right kick to the head could recult in death, YES it could be attempted murder. But aggravated assult is better, IMO, and that is what they are being prosecuted for.

Justin Sloan, a white male, was charged with simple battery for his role in the fight and was put on probation. Because Robert Bailey never made that claim till later. His report of that incident that he gave police is differrent from what he later said. There were also numerous other witnesses and Bailey's history of starting trouble and lying about it.
Can't say I am looking for the Jena 6 to be freed. They had no right taking it to the level they did ... 6 on 1 beating 1 White Student even after he was unconscious. That is a Hate Crime. Ok, well regardless if it is a hate crime or not, it still happened and now the Jena 6 is being prosecuted for 2nd degree Battery. But like I said, I do feel that the Whites originally who hung the nooses should be prosecuted for a Hate Crime, but apparently the law says you can't prosecute minors for this. "sounds racially motivated" isn't going to reach to the level necessary to classify it a hate crime. I agree it seems clear, but evidentiary rules are strict.
As for thousands of whites in jail for this very same thing, there has to be more evidence than just "seems racist to me!" I was almost jumped by falcon fans in Atl, and they were all white. If this was caught on camera it would be another Rodney King, in which all you black people were outraged when the white police officers beat the poor black man (who was high as a kite, driving 115 mph down the highway, got pulled over by police eventually after a high speed chase, and he attacked them.) Then all that was on tape was the incident halfway through so all that was seen was them hitting him when he was down.

Bell lead the attack and was on probation from what I understand and already has a nice record. Thus charging as an adult. Attempted murder is kinda extreme but not out of the question. Especially when attempted murder can be defined as intent to inflict great bodily harm. Just because the kid got lucky and didnt have a bunch of broken ribs and a punctured lung, doesnt change anything. Would be like saying well yeah he shot me but the bullet only grazed my leg so it's ok.

Although attempted murder is a bit extreme, it is not realy out fo the question. A 6 on 1 encounter with the kid getting jumped from behind makes it more than a school yard fight. It shows premeditation. Kicking the kid while knocked out can easily be seen as intent to inflict great bodily harm. Especially because 6 v 1.

It depends on the mens rea of the assailants and if they could determine that the kid was knocked out. A lot of school yard fights are gang-up fights. I was on the receiving end of a few of 'em as a kid. This kid was not seriously injured. A stop at a hospital and he was fine that night.

Fact is, no one calimed this was a "luinchroom" fight. You may need to educate yourself on this matter. i know the news reports have been distorted half-truths (and some total lies), but they are being accused of far more than that. They are being accused of systematically threatening kids on a "list" and beating one of them. Facts are: DA's often start off with the heavier charge and work their way down, Bell and the two who's trial dates have been set were reduced to aggravated assault, they were offered pleas of Aggravated assault with suspended sentences. It's not the big hardcore case of injustice people wanted it to be.

You don't know legal system then. Sometimes it IS maybe it is, maybe it isn't. There is a fine line with attemopted murder and he has a harder time proving it, which is probably why he has dropped charges to 2nd degree aggravated battery. But it is very common to start off with a higher charge, particularly when the investigations are still taking place. It helps in negotiations and it gives them room to lower the charges base don eveidence or lack thereof.

Many in the area wanted him to go ahead with hate crimes, but he upped the charges to attempted murder to appease the people of the community. He lowered them before trials. these are not out of the ordinary.
And yes, if he could prove the conspiracy was to do more than hurt them, and show medically that the right kick to the head could recult in death, YES it could be attempted murder. But aggravated assult is better, IMO, and that is what they are being prosecuted for.

If an ex-con killer is assaulted and he proceeds to beat up the guy who assaulted him, then the fact that he has a violent past does not erase the violence of the assault proponent in THAT instance. Because this one was TOTLLY different from the others. You brought up the great point that many are ignoring. Why was this one diffrent? Read the witness statements and find out. The claim is not a spur of the moment fight. The claim is that a pack of dangerous youths were prowling the school, telling people of a hit list, and telling students they were on it, then setting up a situation where they cornered one, knocked him cold and beat him while down. That is why it was prosecuted differently.

Because Robert Bailey never made that claim till later. His report of that incident that he gave police is differrent from what he later said. There were also numerous other witnesses and Bailey's history of starting trouble and lying about it.

Can't say I am looking for the Jena 6 to be freed. They had no right taking it to the level they did ... 6 on 1 beating 1 White Student even after he was unconscious. That is a Hate Crime. But I do feel the White Students responsible for putting the nooses up should not only be expelled, but Prosecuted as Adults for Hate Crimes.

How is beating up a kid a hate crime? What you and everyone else grabbingt at straws needs to know is that there has to be evidence that the crime was racially motivated for it to be a hate crime. Judging from the facts here, the "jena 6" fight was just a good old fashioned beating. If you know of anything different, link me.

Ok, well regardless if it is a hate crime or not, it still happened and now the Jena 6 is being prosecuted for 2nd degree Battery. But like I said, I do feel that the Whites originally who hung the nooses should be prosecuted for a Hate Crime, but apparently the law says you can't prosecute minors for this. I would still attempt to prosecute them as adults, though. They deserve something more than a measly suspension. They should be expelled in the absolute very least.

But are you also not saying that what happened in Norfolk, VA was also not a hate crime? Thus far, I haven't heard any sort of motive for why those kids jumped the 1 kid. Would you call 6 White Students jumping 1 Black kid for no reason a "simple beating", as well? I wouldn't. Just like if the roles were reversed, and 6 Black students jumped 1 White kid for no reason, that also wouldn't be a "simple beating" to me.

From what I've seen in Virginia thus far, this is what I would constitute a hate crime, unless someone can show me what that kid did to them. Either way, it was uncalled for. 6 on 1 is never justified. If someone wants a simple 1 on 1 fight, ok. But this is 6 on 1 we are talking about.

It requires more than the mere race of the parties be different for it to be a hate crime. If four white kids with no english decent beat up one white kid who's grandparents were english, is THAT a hate crime? Or is it merely an issue of skin shade?

I was WAITING for the first detractor. Listen, I'm not much of a fan one way or the other, but what did YOU do to help the Jena 6? What did I do besides making a free vid? Jesse, Al and Maxine were there leading the charge. Therefore, I can't say nothin' about 'em.

Yeah, but they were charged with attempted murder. Kids fighting back and forth at a high school should not result in only one side going to jail and being charged for a crime they clearly didn't commit. Read up on it.

Well I wasnt there, and I haven't followed the story, attempted murder doesn't sound appropriate, if it was just a schoolyard fight, but if 5 or 6 kids beat up 1 kid, I'd think that was at least assault and Battery

I agree with you,man. The Jena 6 should be freed. The world we live in today, racial profiling and racism still runs amok. We got so many problems in the U.S. but we go and start trouble in other countries and not try to help issues like Darfur or gas prices. Good Song btw.
