This case is over the murder of a young college student and the deception of the EMU administration to the students. Definitely the Clery Act was violated on several counts. I'm sure EMU isn't the only school that has done, or is doing things that violate the DOE mandates...they just got caught. I'm so sorry to hear of your loss, and I hope justice will prevail.

there should definitely be some sort of repercussions inmposed on your school. a fine? that would only hurt you, wouldn't it? i think there should be some non-monetary imposition placed on the school. glad no-one else was hurt while the school tried to feed everyone bull.
Very intersting video Beccah, my point of view is that the college was correct to hold on to information to help in the investigation, i feel its better to catch the killer as long as EMU took precautions like increased security on campus.

As a fellow female EMU student, I totally have concerns about how EMU handled the situation. I remember seeing the death on the news that day, going to my RA and asking what was going on, the response was that nothing happened, and we shouldn't be concerned. It doesn't help that though the staff says that the campus is safe, it clearly isn't- if a reporter can get in, who is to say no one else will try? The whole thing is annoying, and scary, and makes me want to transfer.

Sounds like further precautions should have been taken / warnings given. When did they know someone had the keys, or SUSPECT that someone had keys to access the buildings.? Action should have been taken as SOON as this was even a suspicion. Anyway, you don't find a person dead, half clothed, signs of sexual assault, and NOT assume Foul Play. So it's OBVIOUS that SOME information Should have been shared w/ the students so they can watch out for suspicious activity.

If the university didn't inform you about the possibility of keys to the being in the hands of a murderer, OR change the locks, I would say they were negligent to say the least. However the remedy proposed in the Clery act is like the left pocket getting money from the right pocket. I think a better remedy would include the firing of those involved and filing charges of reckless endangerment.
Negligent, but who punishes them? The Department of Education is the only group that can really hold them accountable. I enjoy the idea of filing for reckless endangerment. I wonder what this would look like had he harmed someone else.

I think that the campus authorities should have reported this incident. Steps should have been taken to warn students how to protect themselves. There was possibly a violation of the Cleary Act.But these become technical issues resolved by lawyers and legislators. They got the right guy because they matched up DNA evidence from a sample he submitted. Maybe they should have announced it after they collected the DNA samples? They were REAL quick about knocking on my friend's door.
I wonder why the dude didn't flee after submitting the DNA sample. I think if I had killed someone, and the cops came knocking, and released me after submitting a sample, I would have been out of town in a heartbeat....

With the evidence you provided it sounds like they may have violated the Clery Act and at the very least it should be looked into to determine if they gave proper and timely notice to students for their safety.
I guess I'm just hung up on the fact that they had this guy on videotape, and let him roam free on campus while they waited for DNA tests. They should have held him if they had him on tape entering and leaving the building at the right times.
Even if they had no suspect in mind, they should have reported it. If only to encourage students to keep their dorms locked, and to rekey that building so the murderer couldn't re-enter the building.
Are you certain that EMU had all the info that the police had? If they weren't aware they couldn't really tell anyone. If they WERE aware then hell yes they violated it.

If the university didn't inform you about the possibility of keys to the being in the hands of a murderer, OR change the locks, I would say they were negligent to say the least. However the remedy proposed in the Clery act is like the left pocket getting money from the right pocket. I think a better remedy would include the firing of those involved and filing charges of reckless endangerment.

Negligent, but who punishes them? The Department of Education is the only group that can really hold them accountable. I enjoy the idea of filing for reckless endangerment. I wonder what this would look like had he harmed someone else.
Interestingly, Jim Vick, vice president of student affairs, has been placed on paid administrative leave.

Upon further consideration and hearing of the video, I'd like to think they had the perp under 24/7 surveillance. If they didn't, add depraved indifference to the charges. And as for Jim Vick's "punishment", where do I sign up for paid administrative leave? What a joke.

I feel that Ethan should be running the entire school, but that's just me. :) On a serious note, since you told me about this Beccah I've been annoyed that the school is getting away with this. They were obviously trying to cover their own rep which should be the last thing on their minds. The safety of the students should have been the first. Unbelievable.

Thanks for watching. It is a huge concern of mine. Even though I don't live on campus, I am still female, and if this guy was willing to rape and kill once, he would probably be willing to do it again.
It's extremely sad. What is even more pathetic is that there is someone here on YouTube who is trying to portray this as a racial thing, calling the suspect a "savage." Check the related videos.

I think that the campus authorities should have reported this incident. Steps should have been taken to warn students how to protect themselves. There was possibly a violation of the Cleary Act.But these become technical issues resolved by lawyers and legislators. Instead of a fine I would support a punishment of perhaps giving students a grant to provide better security for residences. Read my email to you.

it's complicated isn't it? They should have told, and at the same time if they had, it might have been harder to investigate. They did violate it, but at the same time I wonder if there is laws regarding murder investigations and revealing information, and if the laws are complementary or contradictions or else.

They got the right guy because they matched up DNA evidence from a sample he submitted. Maybe they should have announced it after they collected the DNA samples? They were REAL quick about knocking on my friend's door.
I wonder why the dude didn't flee after submitting the DNA sample. I think if I had killed someone, and the cops came knocking, and released me after submitting a sample, I would have been out of town in a heartbeat....

exactly .. thats the kind of information you dont want the police to have, he actualy should have went on a long "holiday" right after he did it.
it is very strange he didnt flee at any point, if he was waiting for them to find out, he could have turned himself over right away.
i still think that announcing the fact someone was murdered could have been done imediatly. but hey, maybe he really was so naive .. and it worked.

the point about laws is interesting .. you might be correct on that one. and i think in a case of contradiction .. the police would "win" as an authority over the EMU.
but as pointed out above .. i dont think basic informations, of which the murderer must assume the police knows about, can make it harder to investigate.

well if i understood it correctly .. you specificly read that they should inform everyone if there is rape/murder .. therefore they should have done it.
but normaly there is always a time restriction like "within 1 month" ..
obviously it can also depend on, if the case gives the impression of a "single event" or of possible recurring crime. whether the offender is her boyfriend or a stranger for example .. makes a difference.

He was not her boyfriend.... but they haven't said anything about how the two were connected, other than that they were both students.
They are making it seem as though he was in the dorm stealing computers, trying doorknobs.

hmm .. well if thats true .. than there was a danger of a recurring crime, and everyone should have been informed.
i dont think that publishing such basic information can have any impact on the case. i mean .. its not like the murderer learns something new ... when you tell him that someone was murdered ... right?
and he obviously didnt make it look like an accident so he knew the police would know it was murder, especialy since rape was involved .. thats always traceable.

With the evidence you provided it sounds like they may have violated the Clery Act and at the very least it should be looked into to determine if they gave proper and timely notice to students for their safety.

I guess I'm just hung up on the fact that they had this guy on videotape, and let him roam free on campus while they waited for DNA tests. They should have held him if they had him on tape entering and leaving the building at the right times.
Even if they had no suspect in mind, they should have reported it. If only to encourage students to keep their dorms locked, and to rekey that building so the murderer couldn't re-enter the building.

Are you certain that EMU had all the info that the police had? If they weren't aware they couldn't really tell anyone. If they WERE aware then hell yes they violated it.
Does whacked out stuff like this happen all over the place? It seems like your school has weird goings-on pretty often. Then again, maybe people just don't mention it when it happens near them. *shrug*

Yes, they were fully aware of what happened. EMU Police found her body and swiftly called in the state police.
My school is weird. There is always something going on here. Sometimes I worry about the reputation my degree will carry with it.
