where I live if you swerve for an animal and damage your car (on a curb for example) or cause damage another persons car (if you lose control and hit someone else) you will be at fault for an accident.
However if you do not swerve for the animal, hit it, and damage your vehicle it is a comprehensive claim and not an at fault claim.
When things like that hapen, you just react, there is no time to think. But try and remember to slam on them brakes but swerve at your own risk.
To be honest, you shouldn't sweve unless it's bigger than a dog... at least that's what was recommended in UK. Swerving will make thing worse, i.e. you could lose control.
@t1sutton It's easy to say that but people react differently to situations. Luckily this road is pretty wide (two lanes going opposite directions with center left turning lane) and it was late at night so very little cars. I've definitely learned something from this and will be a lot more cautious that's for sure.
wierd, maybe they knew eachother, something happened far back, or a thrill seeker hoping it would run the light if they honk! who knows but that is a bit wierd! I hate when there are so many ways to go in a lot like that because this happens, either they dont look or try to beat! I know truckers are professionals but sometimes they do dumb things like that, to me it was a bit fast probably to beat light! sounds a bit scary too! yeah bit overacted but lucky u got good enough tires! possum saved!
@rextinctione It was fast. No doubt he would have hit me if I hadn't backed up. Luckily there was no one behind me so I was able to do so. Almost made me miss my light too. There are a lot of stupid parking lots out there and having that entrance/exit right there is a dumb idea. It was a bit of a surprise. I'm actually glad my car moved as well as it did. It was scary, but I survived, Possum survived (unless another car hit it). If it had rained the situation might have been different, however.
Dodging animals are no fun, especially if they're deer.

@beleafer81 Couldn't help it. Saw a living animal and didn't want it to end up as road kill.
