I'll say that it's possible that the global warming science is tainted by the same sort of politics that Lessig describes. The global warming scientists have both monetary and political reasons to support the idea of man-made global climate change. If they don't, they risk their funding and their scientific careers, regardless of the strengthen of their evidence.
If some scientist ever managed to come up with credible evidence against global warming, it would make that scientist's career, not break it. The world loves a scientific revolutionary. That's why most people have heard of Newton, Einstein, Darwin and Feynmann, but probably haven't heard of Lavoisier, Volta or Rutherford.
