Harrison and an assisting officer made me step out of my vehicle, spread my legs and searched me, while another officer took my keys and began to search my car without consent. He even had the nerve to use said keys to open my trunk, again without consent or probable cause. This was all due to the fact my Reg. was bad

  • The problem to me is this: there is nothing at all illegal about openly carrying a gun (provided that it is unloaded in your state as well as in my municipality) so it is unreasonable for the police to stop you. They could not have reasonable suspicion nor probably cause to expect that a crime was being committed because you were obeying the law. The cops should not stop you unless they have reasonable suspicion.

  • wait,so if you encounter a situation where you need your gun,the clip that's in your gun at the time has to be empty?and so you have to draw your gun,drop the empty clip,load a new one and rack the slide,and get on target?most people have a tough time doing just 2 of those steps without fail.i'm pretty a competent person with a knife could get you before your even half way through loading a clip that actually has bullets in it.these laws neuter your gun.

Hell, if i was on a traffic stop and was getting my stuff pushed in I would hope that a person nearby with a firearm would step in and save my ass. I am not a police officer yet but will be one soon enough. I wish it upon every law abiding citizen of the US to carry a firearm openly or concealed as they see fit.

  • Option 1: Open Carry. Carry an unloaded firearm, with the possibility of LEO interference.

    Option 2: Conceal Carry. Carry a loaded firearm with almost no risk of law enforcement interference, and minimal loss of time.

    Option 1 scenario: Robbed from behind at gunpoint, suspect grabs wallet and runs, by time your firearm is loaded, suspect is out of view.

    Option 2: Same Scenario, except as suspect runs away, you draw your fire arm and fire 2 hits into suspect. You recover your belongings.

If the injunction is granted, we will once again be free to openly carry a loaded firearm in urban areas of California for the first time since the unconstitutional law was enacted in 1967.

    This injunction would, of course, make AB 144 (the ban on the open carry of unloaded handguns) irrelevant.

  • @OI8APC2 There is an unconstitutional Penal Code in CA that prohibits ammo from being attached to the firearm and placed in a firing position (PC12031). Californians may however carry ammo on their person and load up to protect themselves if in danger. This law only puts law abiding Californians at a tactical disadvantage. The pigs use the law (PC12031(e)) to discourage individuals from carrying firearms. I carry for personal protection, not to piss off the cops. I'd rather they leave me alone.

I would prefer that they just left me alone. I carry a video recorder for protection too, and I upload the videos for informational purposes on Youtube. So, you think I am a "jackass." That's fine, you're entitled to your own opinion, even if it isn't based upon the facts.

  • @1775novten I only know the laws of my state. In MN the only way you can shoot someone and Possibly not end up in prison is if you yourself feel in danger of great bodily harm or death. Basically if you were to interfere in someone else's conflict you would end up in prison also. To my understanding taking the law into your own hands may and probably will end you up in prison. I'm not saying that it's right it's just how it is unfortunately.

If you have the time to load your firearm and shoot someone robbing you then you're probably not in the greatest danger possible(death) and had the option to make an effort to get out of there.   • As I see it, there is more of a problem caused by the CA Legislature's failure to provide adequate and proper public education in civil rights, particularly 2A and the need for a population well familiar and proficient with guns and laws, to form militia and supply State Militia with recruits, than it is citizen gun owners practicing their protected rights. If CA fails to grant CCW, then a class of CA Citizens should sue the CA State in June 2012 for 2A infringement.

  • I think that if you decide to open carry instead of conceal then you need to be prepared for what just happened there. I am a permit holder in a state that allows for open carry, but I prefer to keep my fire arm concealed. I do not need any extra attention, especially from someone that I might potentially need to defend myself against. Again, just my opinion.

You have to have connections with the police chief to get one.Second, I have never heard of someone stealing a gun from their holster and using it against them. I think you are referring to criminals breaking into houses and taking unlocked/unsecured guns and using them against the home owners.Also, I open carry because I cant get a CCW, and second, because criminals wouldn't mess with me

  • The officers did not threaten you in any way, drawing a weapon at low ready is standard procedure. I would do the same thing if I approached someone with a gun too. Too many crazies out there... they out number the legal people 100:1.

Neither is a dangerous weapon, until used to commit a crime. Guns may be used offensibly to attack or defensibly to protect. Motive defines use and separates tools from weapons, in a court of law.

    1. Under the law, some forms of weaponry are deemed "too dangerous" to be privately owned without additional licenses and paperwork (Explosives, Fully-Automatics, Cruise Missiles, etc).

    2. You're ignoring the relatively lethality of firearms compared to "knives and screwdrivers"

Unless the society finds reason to prohibit a person living within society, from possessing guns, then society has tacitly authorized the person to bear arms at will, and shall cease infringements.     What I want to see is longer waiting periods, background checks, and an unequivocal ban on the illegal sale of firearms (gun shows, private sellers).

    Paperwork is generated.

    A phone call to a person with the recent CA Prohibited Armed Persons File, approves my purchase.

    I wait 10 days cooling off period to take possession.

    Being honorably retired military, I don't have to perform the safety demonstration.

    I can buy 1 gun every 30-days.

    And, if by chance I wanted to commit suicide, there is a 2-year clause in the policy. (I was licensed for Life & Disability insurance).

  • What point is there to carry an empty mag inside of the weapon? If you had to draw, rather than just load a mag, you would have to drop the empty one then load a full mag.

  • Empty clip yes, But,Good (safe) firearm handling protocal would now be for the carrier to unholster the gun and clear the firearm and decock the firearm (himself) to assure that it is unloaded. By habit, if someone hands you a firearm, you should check it yourself (clear it) to determine the state of the firearm (Loaded or unloaded). What the Cops are doing is not ensuring safety, but puting people at risk. In CA, Can you unholster a firearm to assure it is unloaded after cop pulls this stunt??

    I really can't respect police officers that enforce clearly unconstitutional laws and or any laws that infringe on the civil liberties of the American People. No, These cops don't deserve any respect. Clearly 12031e is a law where they could look the other way when they know those open carrying a firearm pose no threat to them or anyone else.   • @marlboroman67213 I don't live in California, but I know in California the ammunition cannot be in physical contact with the gun itself while open-carrying. For example; you can have a loaded clip, but that loaded clip cannot be inside the gun; and/or you can have an empty clip inside your gun. The cop must have placed a loaded clip inside your gun by mistake, which is his fault, he should have known that that clip had a round(s) in it.

  • For those that don't know, Livermore is a very boring little town in the east bay and police dont have much to do this is why they can waste the time of 4 beat cops to do this inspection. It's going to get worse not better
