OS X is a lot more complex than just FreeBSD with a new lick of paint. It's actually very interesting from an OS architecture point of view.
The kernel combines parts of FreeBSD, NetBSD and OpenBSD and the Mach micro-kernel to create a hybrid-kernel called XNU. ("X is not Unix")
The core of OS X is still open source and you can be compiled into a working OS.
