If you look carefully, you'll notice that he is crossing when his side of the road is clear. The cars that were racing had gone into the oncoming traffic lane to pass the SUV. Also, it's not a passing lane road to begin with, as it's solid double yellow lines.

He may not have used a designated crosswalk, but he wasn't wrong in this case. The two assholes who were racing or chasing each other, are completely to blame.
