The NDAA 2012 did not give the US any more power in regards to detaining suspected terrorists. All the powers existed since post 9/11 (AUMF). All it did is clarify these powers. And you can only be detained if you are suspected to engage in hostilities. Also you do get a trial, in a military tribunal.
