The legal department, that handles foreclosure as a legal matter is a separate and disconnected entity from the loan-modification department. I'm also a licensed RE agent and handled 5 short sales and I'm convinced the banks deliberately delay short sale approval until the buyer gets frustrated after 5 months of waiting and walks away. They would rather foreclose and take property into REO. I'm also convinced they deliberately deny loan modification.

@alexnds1 - I don't know if its intentional or incompetence, but I know the system is broken and the gov't intervention to date has only made it worse.
