I think he's profiting more off of the story, not on the music

also, he's releasing it on DVD so if any rights need to be negotiated then it is absolutely necessary that he does.

Finally, while I have heard this song and the game, I think that it is also somewhat generic and that no one would really know where it came from unless they heard the song and can pinpoint exactly where it came from.
