My friend got pulled over for speeding. The officer told him just go to court and plead not guilty. We went to court and the officer started talking about calibration of the radar gun and everything else. Finally, the judge says "Youre worried about your points, aren't you" He said "Yes my wife will kill me" The judge said we'll just make it so you just went a little over the limit and no points were taken away. If you think asking a few questions will work, get the recording from you trial and share it with us. I dont know it all but know enough to know that nothing is perfect and even if it is, it doesnt mean it will work all the time. Thats why I file many motions as opposed to few. Let alone a few questions.

But, these court goons(Prosecutor, judge) will tell you, the info was available to you if you requested disclosure(officers notes). You usually go in and fill out a form at the court house, several weeks in advance to see what he has on you. Anything pertinent to his investigation of you, should be in his notes.

I had a conversation with a cop that had me hysterical. I asked him if he thought it was okay to lie to a suspect to get information and he said yes. Then I asked him "what if the suspect lied to him". He said the suspect would be charged. I asked him if he'd ever pulled someone over and arrested them for driving with no license. Again he said yes. I asked him if he'd had a legal cause for his action when he did. He said "of course..he was driving with no license". I'm still laughing...lol

I hope they abolish licensing requirements so people can travel around where they please and never be subjected to stop signs, speed limits, and the obligation to yeild the right of way to others. Actually this is a gray area. Legally and constitutionally they can only "suggest" that you stop for safety reasons. IE: A sign that informs you that oncoming traffic doesn't usually stop. If you choose not to stop and you have an accident you could be found at fault because you didn't use reasonable safety procedures. But not stopping wouldn't be the offense. Causing the injury because of neglect would be. Same with speed limits
Its common for courts to "lose" records when it paints them and their authority in a bad light.
The courts are just there to make money off the ignorance of the people, they are not judges, they are administrators....
Thats why every ticket/citation goes to the states department of finance (most of the time to my knowledge) ... the cops are just out there revenue generating.

SOunds like my technique is good enough to make a court delete recordings. So you are wrong. However, I am sure you work for the courts one way or another. @cimasgro In court, one has the right to ask all the questions wanted/needed. Also, many attorneys lose cases because they don't know how to CONTROL THE JUDGE. When the law is on your side the judge must comply or one can escalate to a higher court, something judges DON'T WANT because they don't want to look stupid, cocky/pushy, emotional, or unfair.

Then there is the issue of civil, not everything civil is a contract. You can civilly sue someone without a contract, look at O.J. Simpson and the Brown family lawsuit. Also many laws are civil in the sense that they are citations not contracts. For example keeping your law mowed, not parking in the wrong place, not running a business without a license, hunting without a license, etc. I think this person needs to learn a lot more about the law.

I'm basically saying you have a half decent defense strategy going on, which is respectable...imo.
But, these court goons(Prosecutor, judge) will tell you, the info was available to you if you requested disclosure(officers notes). You usually go in and fill out a form at the court house, several weeks in advance to see what he has on you. Anything pertinent to his investigation of you, should be in his notes.
So the "facts are in evidence" technically speaking. I'm in Canada

I had a conversation with a cop that had me hysterical. I asked him if he thought it was okay to lie to a suspect to get information and he said yes. Then I asked him "what if the suspect lied to him". He said the suspect would be charged. I asked him if he'd ever pulled someone over and arrested them for driving with no license. Actually this is a gray area. Legally and constitutionally they can only "suggest" that you stop for safety reasons. IE: A sign that informs you that oncoming traffic doesn't usually stop. If you choose not to stop and you have an accident you could be found at fault because you didn't use reasonable safety procedures. But not stopping wouldn't be the offense. Causing the injury because of neglect would be. Same with speed limits

Its common for courts to "lose" records when it paints them and their authority in a bad light.
The courts are just there to make money off the ignorance of the people, they are not judges, they are administrators....
Thats why every ticket/citation goes to the states department of finance (most of the time to my knowledge) ... the cops are just out there revenue generating.
The "contract' is the "ticket" . . . you never signed the ticket = no contract.

SOunds like my technique is good enough to make a court delete recordings. So you are wrong. However, I am sure you work for the courts one way or another. @cimasgro In court, one has the right to ask all the questions wanted/needed. Also, many attorneys lose cases because they don't know how to CONTROL THE JUDGE. When the law is on your side the judge must comply or one can escalate to a higher court, something judges DON'T WANT because they don't want to look stupid, cocky/pushy, emotional, or unfair.

Control the judge, now that is priceless, since the judge has to follow the law and trial rules. Just how do you control a judge? Also one does not escalate to a high court, one will petition to the higher court.

Also I don't understand why lawyers are liars... Lawyers are required to be truthful towards the court and they only present the things their clients told them. It would be the clients who are lying. Then there is the issue of civil, not everything civil is a contract. You can civilly sue someone without a contract, look at O.J. Simpson and the Brown family lawsuit. Also many laws are civil in the sense that they are citations not contracts. For example keeping your law mowed, not parking in the wrong place, not running a business without a license, hunting without a license, etc. I think this person needs to learn a lot more about the law.

First the State of California is not a corporation, it is a legal government entity, a creation made to apply the law and serve as the body to govern the people. Think in terms of each state as a country, and the United States as a union, both legal and economic of all those countries/states. This is much like the European Union.
