    He was going to fast. Even by 1-5 you can still get pulled over. Even it's by little. All the do is get the hand speed detector gun and point it to you car. If the Speed Limit for say, it was 40, if the officer sees even a 41-49 and up. He can and will stop you, but most don't because they can't be pointing at every single car. Let's just say this officer was interested in the Lamborghini that is why he pulled him over.

  • @gokarter57275 Subjective my friend. And they are not my words, they are straight from New York Law. No offense, but I litigate these same situations many times a month for my employer. While there are some sources of probable cause that need to be supplemented by other sources, some sources are sufficient enough to stand on their own. I would subpoena the so called "Complaint", and probably find out it never existed. It happens all the time.

  • @vabeachb1 I would agree, but in this case, the event exceeded to term "Brief" detention. Two questions you should always ask an officer once "Brief" has been turned to Excessive. 1- "Am I being detained?" or 2- "Am I under arrest?" If he fails to answer or act, your 4th amendment rights have been violated. By the way, it's called a "Terry Stop" named after John W. Terry v. State of Ohio, 1968.

    As far as a brief detention, I haven't looked at all the replies so maybe there's an extended video posted, but from this video it'd be pretty hard to claim that this event exceeded "brief" detention.

  • @vabeachb1 Dude, it's symantics. Probable Cause and Reasonable suspicion are both basically justification. The point being, Police officers cannot select cars at random. Police need 'reasonable articulable suspicion' that a crime was committed to pull someone over. To make an arrest they need 'probable cause'a slightly higher burden. The only time this would not apply would be under the sobriety checkpoints.

  • @GetsumJ Ok lawyer... A ticket is issued in lieu of an arrest. If you wanna go that route, enjoy. The second you start with that crap, you can pretty much bet that you will be hit with everything from window tints, to safety equipement issues, seatbelt use, on up to speeding. (Because NOBODY does 55mph on Long Island Parkways) And, depending on where you get stopped, if it's in a jurisdiction where the village courts have maintain traffic court, good luck. Enjoy the surcharges.

Yes, 1- LAW § 10-163 : NY Code - Section 10-163, " exhibition of speed", 2 - Section 1110(a), failure to obey traffic device, The cop crossed the center shoulder white line mutilple times. The white line is in fact a "Traffic Device". Did he have probable cause to pull over the Lambo ? Tough to prove. When you are pulled over, they always seem to have complaints on a car or person matching your description.

  • To answer the "Why did he pull you over?" question: A large group of performance cars were reported to be traveling at a high rate of speed. However, non of the vehicles were witnessed by actual law enforcement while "allegedly" speeding.

The fact that he stalked this car for so long was because he was waiting for a safe spot to initiate the traffic stop. Youll see at one point theyre going over a bridge where it would be unsafe. Hope for his sake this guy didn't get a ticket. Good police work in picking the right spot for the stop. Thanks to all the New York State Troopers keeping us safe.

  • I'd like to know the reason for the pull over. Regardless, one thing I wish for was less limits on society in terms of Vehicles. So I have tint, or neon, and like accelerating on the highway, just to slow down and do it again. I know its the police's job, but Fun and personalization have to take place (untampered by Law) at some point. 'Spirited' driving should not be a reason for a Traffic Stop.
