Rape is punishable by death, and does not require any witnesses. This is documented in many ahadith. People like Munawwar Hasan take advantage of Pakistanis not knowing Arabic or understanding the Qur'an and manipulate them for political power. No other Shariah based countries have this law. It has no basis in Islam.

This guy is an idiot. The four witness requirement in the Qur'an relates to accusing another person of adultery, not rape. Surah Al-Nisa talks about adultery, not rape. Rape is punishable by death, and does not require any witnesses. This is documented in many ahadith. People like Munawwar Hasan take advantage of Pakistanis not knowing Arabic or understanding the Qur'an and manipulate them for political power. No other Shariah based countries have this law. It has no basis in Islam.

Absolutely incorrect. 4 witness rule is about adultery, not rape. The verse you are talking about refers to adultery. Aisha was accused by some people of commiting adultery and the verse in the Qur'an says you cannot accuse a third person of adultery without 4 witnesses.
This 4 witness criteria does not exist for rape. This is not law in any country in the world, except Pakistan where no one understands the Qur'an. Not Saudi Arabia not Iran, only Pakistan.

Thus if a woman is pregnant from a rape then she can be accused of fornication since she would be unable to prove that she was raped.

Rape comes under the category of fasad mentioned in 5:32 for which punishment of death is to be given to the rapist not just lashes..And the victim has no blame..

Theek hai Women were not used for work that they are supposed to do like Fighting wars etc in the time of Mohammad (SAW) , But They were Used whenever they were needed for example for serving water to the Warriors at Uhad And also Hazrat Aisha formed an integral part of the later Caliphate Governments due to the knowledge that she had and even lead a war.

I talked about it to a proper Mufti (i.e. a qualified legal jurisprudence scholar of Quran and Hadith) and I was told that actually 4 pious and upright witnesses are only required before u can punish the involved people with stoning. Whenever the 4 witnesses are absent u go to a normal court or qazi. This is the Sharia law and this is the Hudood law. This idiot maulvi doesnt know his stuff and he is defaming Islam. @stealth009 Isnt he the one misleading? He should be telling them about the rulings on the topic by the four Imams which as I said say that when u dun have 4 imams u go to a normal court. He doesnt even quote the actual words from the Quran or discuss under what conditions those ayats were revealed. To me it appears that he didnt know or remember the details, which is human I'd say but then he apparently just improvised. Unacceptable. People in his place should be more careful.

Only a couple of people were stoned in the time of Muhammad (pbuh) and only because they insisted to be punished now instead of being punished in the hereafter. Hadith has it and its not a weak rating hadith either. It tells how the Prophet tried to pretend to look the other way when the person approached him with the confession. Tried to ignore him so that he doesnt have to go ahead with stoning.

Plus dealing with apostates has always been a debated topic in Islam. Many scholars have not suggested capital punishment for it.
