legally it was the cars fault but technically it may have not been the cars fault. Its like my friends accident. It was raining and he got cut off by a guy in a mercedes who then immediately slammed on his brakes. Legally he was at fault because "you should always have enough space to stop" but technically it was the guy in the mercedes fault because he have my friend no room to stop. he wasn't following too close by choice u know?
