Bingham's statement is not law. That was from a debate on the Civil Rights Act of 1866.
Two years later, the 14th Amendment was passed, and as I pointed out yesterday, there is no language in the 14th Amendment that says anything about parents.

It was widely used by nations in that era. The Constitution was signed on September 17, 1787. The signers used it as a legal reference document and referred to it often. This is historical fact. Read the legal definition of "Natural Born" in the document. Mr. Obama is not "Natural Born" based on that definition.
De Vattel never used the phrase "natural born citizen". He wrote in French. That phrase did not appear in a translation of "Law of Nations" until 1797, which was a decade after the Constitution was signed (as you noted). Unless the Founders had a silver Delorean time machine, it is impossible that they used de Vattel's "defintion" of natural born citizen. Also.. de Vattel referenced only 2 types of citizenship - 1. citizen at birth, 2. naturalized.

If you are born in the US (14th Amendment), you are a citizen at birth (natural born).
If you are foreign born and become a citizen, you are naturalized.
Those are the only types of citizenship in the US.
There is absolutely no reason that a person born with dual citizenship can not be a natural born citizen of one country or the other.

Whatever a treatise written in 1759 says - a treat not explicitly adopted by the founding documents - is irrelevant because the question has been legally settled by the 14th Amendment and Title 8. Those are the laws of the land, not the Law of Nations that predates the founding.

Title 8 of the US Code, Section 1401 outlines 8 categories of how a person acquires citizen at birth status. People that fall into any of those 8 categories are considered to be natural born, and are eligible to serve as President/VP.

Bingham's statement is not law. That was from a debate on the Civil Rights Act of 1866.
Two years later, the 14th Amendment was passed, and as I pointed out yesterday, there is no language in the 14th Amendment that says anything about parents.

@chriscyrek The Law of Nations (1758) by Emmerich de Vattel is a legal treatise (not treaty) that applied to the conduct and affairs of nations and sovereigns. It was widely used by nations in that era. The Constitution was signed on September 17, 1787. The signers used it as a legal reference document and referred to it often. This is historical fact. Read the legal definition of "Natural Born" in the document. Mr. Obama is not "Natural Born" based on that definition.

De Vattel never used the phrase "natural born citizen". He wrote in French. That phrase did not appear in a translation of "Law of Nations" until 1797, which was a decade after the Constitution was signed (as you noted). Unless the Founders had a silver Delorean time machine, it is impossible that they used de Vattel's "defintion" of natural born citizen. Also.. de Vattel referenced only 2 types of citizenship - 1. citizen at birth, 2. naturalized.

They did not need an English translation in 1787. Historical records tell us that Ben Franklin spoke and wrote in French and by 1732 taught himself to read, write, and translate German fluently. Notice the word "Citoyens" (Citizens) only appears ONCE in the French text but it appears TWICE in the English.
Earlier translations said, "The natives or INDIGENES......"
It did not say 'natural born citizen' until a translator inserted the phrase in 1797.

So it is reasonable to believe that it was accepted as correct in meaning and intent as a legal reference at that time. If it was thought to be wrong by some, history would have recorded that and the document would have been corrected. And yes I do like the name. It is good to have a lively discussion.

We know BHO Jr was a British subject due to the fact that BHO Sr. was a British subject and therefore, BHO was a British subject. Therefore, while BHO Jr. may now be a "naturalized" citizen, he may NEVER be a "natural born" citizen and therefore is ineligible to be POTUS, regardless of his place of birth.

Title 8 of the US Code Section 1401 outlines 8 categories of how a person acquires citizen at birth status. People that fall into any of those 8 categories are considered to be natural born and are eligible to serve as President/VP.
