And that goes down the line. When I get a case about discrimination, I have to think about people in my own family who suffered discrimination because of their ethnic background or because of religion or because of gender. And I do take that into account.

It is clear to me that her statement would make her a biased judge who shouldn't serve. In terms of the law ones one life experience is should not be superior to another's simply based on their ethnicity.

Alito may show how his background my influence his decision here but he doesn't claim his background is superior to someone else's background. He doesn't say that a white man can make a better decision than a Latino woman. Had he said that he would not have been confirmed. Plain and simple.
