And that is what sotomayor did she looked at the 1964 civil rights act, which stated it affirmative action should be implemented and she put the law as is. I don't see how she would even have such a power. One justice can't simply *declare* that the border should be open. There would have to be some case about border law, the court would have to decide to hear it, the constitutionality of border law would have to be at question, and then she would have to get a plurality of the justices to agree that relevant border laws are unconstitutional. That's just an absurd scenario.
