  • In NY, if you fight the ticket, and win, you have to pay the $80 dollar legal system fee. Which in my town is four times the amount of the original ticket.

  • taking somthing to court in scotland when your innocent or guilty will incurr a more severe sentence from the court ,and they will gladly tell you this ,the will send you a conditional offer say a £40 fine for a traffic violation which will say plead guilty and pay the £40 or not guilty ,but if you plead not guilty or not respond then you will be summoned to court where you may incurr a fine greater than the origanal offer if found guilty.it part of the intimidation

  • Who's the real party in interest? Did that party state a claim? Can that party show proof of claim? NO...case dismissed.

  • What's the difference whether you pay the courts or someone else for assistance on these types of tickets? You still loose your valuable time and money! For instance, I was cited for not having a front license plate, while being parked. Question is that I was unaware of having a missing front plate, and whom did I harm? Is this not an honest issue, and what about time money and time during the DMV process to obtain a replacement? Why does the city feel obligated to issue a $55.00 cost? For $!

  • This video is good as far as it goes but Macedon51 is correct, we can't be charged with an offence unless we agree to the statute having power over us. See the video on my channel about returning the charge notice from whence it came and claiming no consent-no contract, so far (touch wood) it has worked for me. Also, if you deregister your car as advised by the Freeman Movement, they have no power to seize it or put a boot on it. When we register it gives them ownership of the car.

  • Haha. This guy obviously has no friends, family, or even acquaintances that are in law enforcement. My own brother spent 2 years as a parking enforcement officer, and is in his 5th year as a patrol officer. Nice try dude, but quotas are illegal.

  • This guy is an idiot or a liar! He is accepting the scam as valid. All parking tickets are scam. There are statutes, codes and laws. The laws apply to everyone. The first two are not laws and have force only if you agree to apply to you.

  • This is bs. The court will forgive minor errors. Now if the plate or vin is wrong, then maybe. But just the color of the car is silly.

  • @Forensource That's true where I am. The court has the power to "ammend" errors on the ticket, even after the trial has begun. If you get to trail and make a motion that the case be dismissed because the color of the car, or something similar, was wrong, the court will just ammend the ticket, right there and then, to correct the information and the trial will proceed.

  • thats BS advice! now a days they print ur info out on the ticket just by entering you license number! and who the hell has time to go to the court to save 20 bucks that will cost you anyways if you park in a parking lot while u go to the court!

  • @scorpiorulz13 You should always fight a ticket when you can. Between the time the ticket is issued, and the day of your court date, any number of things can happen to have the case dismissed - clerical errors do occur, prosecutors get bogged down and decide to drop your charges in lieu of going after bigger cases, etc. Tons of stuff might happen that result in you getting a notice of dismissal in the mail.

  • @scorpiorulz13 And, if you really don't want the hassle of going to court, just wait until a week or so before your court date and pay your ticket. You're not out any more than you would have been out by just paying it right away. But, if you just pay it, you've thrown away all those chances at a dismissal.

  • @scorpiorulz13 Also, if you fight it, you can contact the prosecutor's office at any time and attempt to bargain a reduction of the fine in exchange for a guilty plea. 9 times out of 10 they'll go for some sort of a reduction. That's how those "If you don't win, you don't pay us." places that fight traffic tickets work - they consider ANY reduction in the amount of a fine as a "win." And, they can almost ALWAYS get a reduction by doing just that.

  • this is good...try putting change in meters right in front of a parking authority scum bag zombie. it really pisses them off. i've been working on a little video project doing this in my home town chicago. one man actually chased me down and grabbed my arm hard and screamed in my face. haha i got it all on video. i'm planning on sending it to a network station and on youtube when i get 20 solid minutes of awesome foot. these jags are crazy about people doing a good thing for random people. lol

  • Then...the DA might try to call you at home. This is what I always say when he/she calls me: I don't wish to do business on the phone. If you want something, then write me a letter.

    The DA will try to ask you stupid Q's and get you into a contract on the phone. DO NOT SAY ANYTHING ELSE! Do not say that you are "JOHN SMITH" i.e. Say: I am the attorney in fact for JOHN SMITH...very important.

  • He is a Moron! The Parking Ticket is a CONTRACT! You accept the Ticket/Contract after 72 hours. You have the right to reject ANY contract/Ticket within 72 Hours. This is what I always write to them: Take the Ticket and write in Red ink "REJECTION" across the ticket. On a seperate sheet: To whom this may concern, you offer to contract is being rejected under the federal Fair Debt and Collection Practices Act (Regulation Z). Anyone who responds to this must respond under the penalties of perjury.

  • you are right in that there are good cops and bad cops, particularly in parking enforcement. hence, i said 'probably did something wrong.'

    my real point is that people should own up to their responsibilities. if you were in the right, then absolutely fight it through the appropriate channels with my blessings. but if you know you're in the wrong, then man up and pay.

    my complaint was more about people trying to weasel out of valid tickets than people who get screwed by a bad cop.

  • 1) i work for a privately funded university, so there's no 'government bureaucracy'

    2) there is no union, so there's no 'bloated union benefits'

    3) learn to spell bureaucracy

    4) nothing you said changes the fact that if you park in a fire lane then you deserve the ticket and should pay for it. tickets aren't written randomly. if you got one, you probably did something wrong and you know it.

    so i say again, pay the fine, grow up, and deal with it.

In the real world, every traffic enforcement agent (TEA) in NYC knows that there exist certain places where regulations are ambiguous and the unwary might park and be issued tickets. These tickets usually can be dismissed if challenged. It doesn't stop the TEAs from issuing them. I know someone who wins 90% (soon to be 95%) of her NYC parking tickets. She parks where TEAs think they can ticket; she proves them wrong by getting them dismissed.

  • @nerdwithoutthee When government slings 90% bogus tickets at you, you are justified at fighting the 10% that are actually valid. It is not a "man up" thing. It is about organized corruption of the government and deliberate indifference to the civil rights of drivers to be left alone when they are doing nothing wrong. You did not make this point. Indeed, you suggest that it never is justified to fight a properly issued parking ticket. When the system is corrupt, all is fair.

  • i am so sick of hearing people whining about getting parking tickets. if you don't want a ticket, then don't park illegally. it's as simple as that. i work in parking enforcement and i've seen the worst of the worst. i once ticketed a guy for double parking across two handicap spaces who wasn't handicapped. and he had the nerve to give me attitude for writing it.

    if you're in the wrong, just pay the fine. you know what you did. grow up and deal with it.

  • I got a speeding ticket where I wasn't even sure if I was the one the officer meant to pull over (I had seen another car go speeding through the curve, but I had slowed down). When I read the ticket, sure enough he had filled in that my car was red (the other car had been red) but my car is tan. I took pictures of the curve where he had been sitting including the view he would have had of traffic and pictures of my car with the license plate showing. The magistrate ruled "not guilty"

  • Excel Parking Sheffield Yorkshire issued me with a ticket for being in a disabled bay without displaying my badge. The badge had falled onto the floor as my passenger got out, we did not notice. the parking attendant agreed the ticket should be cancelled, but Excel refuse to do this. This company is out to make money out of drivers - if you do pay your fine and ring their payment line, it costs a staggering 50p a minute premium rate and the introductory spiel takes up at least one minute.

  • This is a civil case. How can you be "guilty" or "not guilty" in a civil court matter?? You can only be "guilty" of something when a crime was committed, as in causing injury or loss. What crime was committed if you got a parking ticket? Who's rights did you violate?

  • You can be guilty of breaching a by-law. parking is governed by by-laws in many places not criminal law. Therefore not a crime

  • Actually, you don't need to request a court hearing. Simply write back, tell them not guilty, and if they want a court hearing then THEY will need to request it at a mutually convenient time. (you may need to reiterate this because they may pretend they didn't take notice of the content of your letter). They eventually cancelled my ticket citing "an error" on my file.

  • Tubealard, the fact that somebody made a few spelling mistakes in an informal situation and with a language where spelling has minimal consistency does not mean that they have bad English. More importantly, it does not deny them the right to ask for guidance. Calling somebody a moron on this basis is incredibly narrow-minded, offensive and unnecessary.

    Which country?  Statute law still dictates innocent until proven guilty... The ticketing agency say your option is to request a court hearing. Actually that is just one option, and not you only option. Another option is one that they choose not to tell you about. You can write back and tell them something along the lines of:

  • Part 2 "Dear ***, there is an error because of ***. and I am not guilty. Therefore it is not a legal requirement for me to request a court hearing. If you want to persue this matter further, you will have to request the court hearing at a mutually convenient time. regards...*** "

  • Did you forget to mention that officers can amend their citations in court to correct the mistakes and it would help to mention how much court fee cost on top of what the violation fee. Costing 80, 90 100 dollors.

  • Only 50% of North American Cities maintain a "QUOTA" as it were. You'll find most others do not. OUr City has no reason to write bogus tickets, there's no pressure on the Officer, so, if you get a ticket here, you probably deserved it. Absolute Liability offence, means your car was there or it wasn't.
