I don't think the original artists would be upset to find that modern artists still enjoy their music and find it worthy of updating. I think many would be grateful that their work was being taken off the elitist shelves and put back into popular circulation where it can stir and inspire the common man. =)

The reason you can't just copy someone else's work is because they have a patent on it, which is protected by the copyright laws of the country you are in.

I'm not sure about other countries but in the U.S. patents last 20 years for anything you invent/compose. After that it's public property.
