If that was the case then why didn't they simply use the actual song? The answer is they do not have permission. These videos are portions of DVD that is available for sale. If the video is sold and contains pieces of music that are used without owning the rights to that music they can be sued with either cease and desist orders, fined, or made to pay royalties.

@0ngus If you listen to the actual solo where I copped the IDEA of this lick the phrasing is different. To change it up and stay out of court I adjusted the rhythmic placement.
