In self defense, you do not have to wait until you have been physically touched, but just the threat has to be present, which it was. The problem is that most people don't realize that if it were to get to trial, you are not required to have a jury. The defendant can choose a bench (judge) trial.
If you get a sympathetic judge, maybe. But I still think the likely outcome if you were to turn a verbal confrontation into a physical one, is that the panhandler would get charged with Disorderly Conduct and Solicitation by Intimidation, but you would be looking at Assault & Battery. The latter is a more serious charge, so with our legal system the bum would probably end up the winner in the end.

This was videotaped and is admissible evidence to bring charges against this individual. What charges have the local prosecutors levied against this person engaging in attempted robbery? What is going to happen when this criminal makes good on his threats against a citizen?
The interviewee handled this well. Better than I would have. I would have taken advantage of several of the self-defense laws that apply in this situation.

I think it is ok to have some groups that are not part of the racial majority....just have immigration policies to assure that this group does not get too large. I would not allow any blacks in, they do not fit into a modern society. Stock up on guns, ammo, canned food and a huge blockhead type dog.

He isn't as crazy or as dumb as he looks. That panhandler correctly sized up the commissioner as some guy who had to be polite in front of the camera and wanted avoid a fight, so he figured he could keep getting back in his face and talk all the trash he wanted. I would've responded with a fist too, however, because the interviewee is a politician (especially the County Commissioner) he did quite well on camera to not respond negatively. His constituents will be happy now. He probably would've reacted differently in a different situation (not outside of the museum with children and his mother present).
