Hi, as far as I'm aware the US public domain cut off date is still 1923 until 2018 or 2019 when later works are finally freed up. So this wouldn't technically be Public Domain. The performance isn't the issue, its the composition they're probably claiming copyright to, especially if it was renewed. This is all thanks to the Sonny Bono Copyright Extension act, which made everything protected another 20 years.
Alberta Hunter has such a nice voice... and her delivery reminds me of Eva Taylor.
