This is an issue of excessive force being used and about a threat that was already eliminated. The pharmacist had successfully defended his co-workers when he shot back to hit one suspect in the head and cause another to run off out of the store. What fucked the pharmicist was the way he calmly walked past the robber and grabbed the second gun with his back turned. The robber clearly no longer presented an imminent threat so it's no longer self-defence. Defence should have argued that robber was probably already deceased. There's no actus reus beyond reasonable doubt if the robber may have already been dead.
An autopsy would prove that the robber was not dead and thus Ersnt would have the actus reus of first degree murder, that is a weak defense, as most impossibility defenses are. The defense should have argued that the murder charge should be dropped to manslaughter because the robber provoked Ersnt to kill him.

The pharmacist protected himself and properly exercised his 2nd Amendment right to KEEP and BEAR arms. The DA needs to go back to law school. Furthermore, the pharmacist "properly" neutralized the threat inside the store. This is a cut and dry case. The pharmacist came back to make sure the "perp", who he shot only once in the head, was properly neutralized. One shot to the head is "not" a guaranteed kill, nor does it mean the "perp" he shot was necessarily unconscience.

The 2nd amendment only gives you the right to own the gun, it doesnt determine how, when or where they can be used.
And its a fact that the robber was unconscious on the ground. Laying down in a pool of your own blood after being shot in the head gives that away. Any responsible person, sane or not (or in the pharmacists situation, should be able to realize that.
