He decided to come back in the middle of 2009 season. F1 teams are not allowed to do testing until end of the season, so he had to drive something close to a car for next season (and F1 cars from year before had electronics and were designed under different rules, so GP2 was better alternative). Michael asked FIA for approval to drive 2009 car (i dont know if he was already talking with Brawn to join his team at this point rather than any other team), but he was denied.
