Ticket giving it based on the officers discretion in many cases. If someone is being a bitch or uncooperative they can indeed give them a ticket, or worse--arrest them.
The charges in that case are minimal and the person is out of jail very fast, usually without a record, but still, it's a fact that they can do that.
