I am a Ron Paul supporter and would argue that yes, national health care, Medicaid, Medicare and SS are all unconstitutional. However, I do concede that the Constitution was written in such a way as to make that opinion arguable. I don't believe we could garner the support in Congress or the public for repealing any of those programs, so the point is moot. I would personally support a health care system similar to perhaps the Netherlands IF they would pay for it with overseas/empire money.

Can't Health Care be considered a part of general welfare? Just remember that some of the advocates of the independence of America were proponents of government's role in providing basic necessities of the public. For example, Thomas Paine was a fierce advocate of universal education.

To consider health care as a power given to the federal government under the "General Welfare" clause is to stretch the meaning beyond its original intent. "The words "General Welfare" in the introduction to the enumerated powers of Article I Section 8 were never intended to be an object for extension of the power to tax and spend."

The powers are known as the "enumerated powers" which clearly left-wingers do not under stand. All powers that the government s supposed to have are enumerated by the constitution. Clearly, Congress has claimed more power than the Constitution permits.

I admire the Judge very much, but he left out "..to provide rules for captures on land and water..." Which means that the CONGRESS has the CONSTITUTIONAL AUTHORITY to keep Guantanamo OPEN... and there does not need to be a TRIAL to keep these captures... unless Congress says so.
