Ah but MT, being *anywhere* on the Internet(z) makes someone money. Vimeo is a far better video sharing company when it comes to policy but their technology is no where near as polished as Google's, otherwise everyone would flee YouTube and go to Vimeo if only because Google's policies are the strictist even when the law allows for broad windows of resolution.
Also the DMCA was passed without citizen involvement, it is a corporate crime against us that citizens had no say-so in.

Are there? This remains to be proven in a court of law and this is not the first time this has happened. Very few of these law suits actually get to court. If any. I seem to remember a guy who actually persued these things in court. Remember Inmendham?

Are they? Show me your evidence. I think they have enough money to hire some pretty good lawyers and these are the guys who write that user agreement that we all accepted when we signed up with YT as users. If you are so passionate about it why don't you do it?

well im not a lawyer like dpr, but youtube has set up a system with little to no legal recourse if you are falsely DMCAed. i mean if someone used a troll account, and gives youtube a lot of fake info it could be hard to track them down. it is only made worse seeing as how they don't need proof of copyright infringement and only n accusation. and seeing as how most of this is automated they don't have anyone available to assess claims as valid or buullcrap.

I agree with you on all counts. And yes it sucks. And no it's not fair. None of that really makes any difference. At the end of the day it all must be decided in a court of law or nothing changes. All I'm saying is that everyone on YT accepted the terms of use in order to get an account. YT is not required to be police or uphold any level of fairness.

Nope, that's what's sad, they ARE required to be police (that's what the DMCA complaint form is for) but apparently they don't exercise any judgement as to whether the DMCA is legit or not. Yank it first, ask questions later.

Well when confronted with evidence of false DMCA's youtube WILL kick users off for doing this. Also, false filing DMCAs is a crime, but I'm not sure if anyone's been sued for doing this or prosecuted. Most false DMCA filers are probably losers with nothing worth suing for, but if if it could be proved that someone like Ray Comfort was doing it (not saying he is)...woo! what a gold mine!. The system is deeply flawed as is, though, you're right, guilty until proven innocent.
