tort litigation is NOT on the rise and has been in fact decreasing. the above video is a perfect example of "tort tales": exagerated and misreresented "stories" that distort the truth. the Pro-Tort refrom movement is vey powerful and these are the types of methods they are persuing.
kmctop33, actually McDonalds proudly demanded their day in court and showed how they only had 700+ other complaints about being burned by their coffee. The people who posted this are shills for their corporate masters. Mc makes over $2.7 million every 3 days in coffee sales which is what the jury originally awarded. The judge reduced it to 3 times the medical cost. No wonder McD's don't care. There may be frivolus lawsuits out there, this aint one.
The Mcdonalds lady had 3rd degree burns that required skin grafting, no surprise here considering the coffee was 190 degrees and merely asked McDonalds to pay her medical fees, they flat out refused so she took it them to court.
she was 91 and when she opened the lid it went on her lap and ankles she had 3rd degree burns, there we 70 other cases of people saying the coffee was to hot (190 degree coffee)
Why don't you get your facts straight before posting a video like this? You failed to mention that McDonalds heated the woman's coffee to 190 degrees and gave her 3rd degree burns.
first of all. the hot coffee was 190 degreess F. Water boils at 212 degreess F. Did you ever see the burns?! I think not. She was an elderley woman and the hot coffee made her have 3rd degree burns and it burned the inside of her leg skin off.. i think you sould take that off because that is very misunderstanding..
@IbarakiStyle Yeah, and you fell for it didn't you? All you need to see is 1 1/2 hours of horrible burns, some sympathetically composed soundtrack to back up the horrible story and POOF, you think McDonald's is ran by Satanists.. Sue sue sue.. No, the woman put hot coffee between her legs, in a car while driving..She was burned..Any 6 year old learns this.. Hot liquid will burn you.. simple isn't it? but no, you fall for it.. and the blood sucking lawyers become heros? UNBELIEVABLE
I`m suiting U-tube for putting this video up and I can`t stop thinking about the chick in 4:33....I want 5 easy payments of 1 billion each year. (Btw, I remember No.1.)
Are you kidding me? the coffee woman had suffered third degree burns on her thighs and buttocks, resulting in almost 20,000 dollars in medical bills. The woman originally only asked for enough to cover the hospital, McDonalds offered 800. The coffee that was served was 190 degrees, 50 degrees higher than the standard. McDonalds also admitted that over 700 people reported burns from their coffee and that if it were drunk immediately it would cause burns. Google for pics, the woman deserved more
@XxGreymoonxX I am (BY RAW EMOTION) seeking out those that fell for this Hot Coffee piece of crap documentary... NO, she had zero right to sue.. When we are young, our parents teach us that hot liquid will burn you.. Some of us may have been burned a few times as well.. I HAVE. It's like suing the manufacturer of a dumbbell company because it was heavy and I dropped it on my foot breaking all of the bones.. No, tort reform is a great thing.. and Hot Coffee proved it!!!
If you want to know the truth behind case no. 1 and how the facts were manipulated in the media to make out that it was a "frivoulous lawsuit", check out the documentary Hot Coffee. The woman recieved third degree burns over 16% of her body and she never fully recovered from it. She couldn't pay the medical bills so her family tried to get McDonald's to cover it with their insurance, but they insisted on going to court with a jury.
@KristofskiKabuki I have rebutted this to many.. Why? Because I know what law suits really do to a company.. No it was 150% the woman's fault.. It is a shame it happened.. but if I were a betting man? I bet she had decent parents that taught her that hot liquid could burn her.. Even if they were horrible parents and actually BURNT her with hot liquid she would have learned this.. Or in school possibly? In any case if she had the information that hot liquid burns? It's her fault
@SuperGuitarman69 But would anyone expect to be given a coffee from a cafe that was capable of giving them 3rd degree burns? That's where the problem is.
@KristofskiKabuki You know I wouldn't expect a 5 pound dumbbell to break every bone in my foot.. Nor would I expect a laptop to do the same, so if I drop it on my foot, should I sue Macintosh for not making the laptop with handles? So no, it doesn't matter whether she was moving, stationary, or dancing with a chimp.. The fact remains, coffee is hot, very hot, don't drop it on you or you will get burned. 3rd degree burns, or merely a mild red spot.. It is personal responsibility
@SuperGuitarman69 That's a straw man argument and in no way comparable. Yes, people may spill their coffee on themselves, and they may get a burn from it, but you would never expect any cafe to sell coffee that was hot enough to cause burns that require skin grafts. Besides, they were only asking for enough money to cover medical bills, which seems pretty reasonable to me, but they refused to pay it and took it to court instead which is why they got so much
@KristofskiKabuki This is why tort reform is important.. If the plaintiff loses the case? They should have to pay all of the expenses of the defendant.. 86% of all frivolous law suits IN FRONT OF A JURY ends in the defenses favor.. but the costs are passed on to the consumers.. So tort reform is necessary.. Lawyers abuse the system.. They MUST know FOR SURE they have a case before ever taking it to court. PERIOD
@SuperGuitarman69 As I said in my other comment, Macdonalds refused to pay the medical costs (which would have come out of their insurance and not actually cost them much). It was their decision to take it to court, which is why they ended up paying so much. So they only have themselves to blame
@KristofskiKabuki McDonald's shouldn't have paid a dime.. She spilled the coffee. Temperature isn't a factor.. Hot is hot.. another example.. A man is standing in line at Starbucks.. Get's one coffee black.. Turns around and throws the coffee on the lady behind him.. It burns her and disfigures her.. Should she sue him? Or Starbucks? Who is the one responsible for her getting burned? The coffee maker? Or the man throwing it? Possibly the girl that made the coffee?
@KristofskiKabuki Another example.. A woman is in a court yard at a public building.. she wants to test out how sturdy the statue is in the center of the court yard.. So she walks up to it and gives it a good shove. It falls immediately on her and kills her.. Now, should her family sue the city for putting up such an unsecure statue? ALL of this is relevant.. And I am trying to show this to you!
Oh please. #1 was clearly the fault of McDonald's. That coffee caused THIRD DERGEE BURNS that required skin grafts. The styrofoam cup DISINTEGRATED due to the insane heat, it did not spill.
In all honesty, back when the coffee lawsuit took place McDonalds was still using those flimsy, styrofoam cups. With the tempature of the coffee and the cup, it was eaisly hot enough to begin melting and breaking down the styrofoam. Trust me, I've been burned REALLY badly by hot soup stored in a styrofoam cup and it is dangerous and easy to spill even when you're careful.
#1... Google search the injuries that woman received by the coffee, the coffee was nearly boiling hot and she had to get skin grafts for 3rd degree burns... I wouldn't want to spill, no less drink boiling hot coffee... Coffee you brew at home is about 50-60 degrees cooler than the coffee was at McDz... Kinda changes your mind when you know the facts huh?
This as most claimed "frivilous" lawsuits are either factually inaccurate, or fail to present the entire story. In most instances, these and other similar websites are insurance company or Chamber of Commerce backed propoganda. If you haven't seen it yet, watch the recent HBO documentary, "Hot Coffee". This will give you a more objective view of what goes on out there.

*Sueing yourself??? Sorry but that should have earned him a DEATH sentence to be carried out IMMEDIATELY, no one that freaking stupid should be allowed to live.
*No warning signs at Sea World for killer whale tank??? What part of KILLER whale do you not understand. Now we have an entire family that are so stupid they should not be breathing right now.

she invinited him in for sex and then realising it was not took him to court for tresspassing and attempted bugarly
it was found the in the situation she invited him inside making breaking and entering null
Oh,wow! What part of KILLER whale was hard to understand. Those parents should have known where their child was. Sue a park for your own dumb parenting. Interesting. I'm surprised those parents who leave their kids in the car to bake don't sue the car manufactures for not having an alarm to remind them to get their kid out of the car.
BULLSHIT! That was cold blooded murder, not a simple mistake. Fascist pigs murder people daily in this country and you would have to be mentally retarded to mistake a a heavy metal pistol for a plastic dart gun.
I think the American people are too smart to fall for this "tort reform" lie anymore. It is denying our rights to due process.
